(a) Suspension or Revocation. Any license or registration issued under this chapter may be suspended or revoked by written order of the Canton Construction Board for any of the following:
(1) Any violation of the Ohio Revised Code or City ordinances relating to HVAC/R work.
(2) For any failure to immediately, upon receiving notice from the HVAC/R Inspector, repair or correct any work previously done which may be found in any respect to be defective or unlawful.
(3) If the registration was obtained by misrepresentation or fraud.
(4) If the business transactions of the contractor have been marked by a practice of failure to satisfactorily perform its contracts.
(b) Records/Violations. The HVAC/R Inspector shall keep a record showing the date, name of registrant, location, and owner or person in control of property, where any work is performed contrary to City and/or State code requirements or where any HVAC/R contractor has failed to obtain a permit as required in this chapter. The HVAC/R Inspector shall provide written notice to the permit holder of such defects and the permit holder or person responsible for the job shall immediately correct such defects. If the permit holder claims that the work or material on the job is proper, he shall, within two business days after receipt of notice from the HVAC/R Inspector, appeal the determination of the HVAC/R Inspector to the Canton Construction Board. The Board shall order a reinspection of the job by another HVAC/R Inspector and notify the permit holder of the results of the second inspection. If the permit holder is dissatisfied with the report of the second inspector, the Board shall, upon written application of the registrant made within three business days after the second notice, give the permit holder a hearing and the decision of the Board shall be final. The permit holder shall thereafter immediately correct the defects determined by the Board to exist or be subject to suspension or revocation of his registration pursuant to subsection (a) hereof.
