The Canton Construction Board shall meet upon the request of the Board Chairperson and shall have such powers and perform such duties as are required herein.
(a) The Board shall, upon application, consider appeals of the decision of the Chief Building Official or his designee with regard to whether any applicant for an electrical, plumbing or HVAC contractor's license has the requisite experience to be licensed in the City.
(b) The Board, upon the request of the Chief Building Official or his designee, shall have the authority to make recommendations to Council to accept or reject the use of alternate materials, devices, methods of assemblage or installations, fixtures or appurtenances relative to electric, plumbing and HVAC, within the City that are not in conflict with any State law, rule, regulation or requirement.
(c) The Board upon the request of the Chief Building Official or his designee shall assist in the interpretation of the rules and regulations of the applicable provisions of the City Building Code subject to subsection (f) hereof.
(d) The Board shall hear and decide questions involving the suspension or revocation of various trade contracting licenses or registrations issued by the City, and also hear and decide questions involving revocation of permits issued by the City.
(e) The affirmative vote of the majority of the members present at any meeting shall be necessary to pass any resolution or make any decision or recommendation. The Chief Building Official or his designee shall not participate in any vote being considered by any Section on which the Chief Building Official or his designee has previously made a decision. However, the Chief Building Official or his designee shall be allowed to vote upon any such matter when considered by the full Board.
(f) The Board shall have no authority to hear or decide questions involving the interpretation or application of the Ohio Building Code or the Residential Code of Ohio or any other area of responsibility of the City Board of Building Appeals. Nothing in this chapter shall be construed so as to diminish the duties and responsibilities of the Board of Building Appeals.
