153.06 REFUSAL BY CITY TO DEFEND; WHEN EMPLOYEE MAY RECOVER COSTS OF HIS DEFENSE FROM CITY.
    (a)   In the event the City fails or refuses to provide a legal defense against a civil action brought against an employee after proper notice and the employee retains his own counsel to defend the action, he is entitled to recover from the City such reasonable attorney's fees, costs and expenses as are necessarily incurred by him in defending the action if the employee establishes by a preponderance of the evidence that he would have qualified for indemnification under provisions of Section 153.02.
   (b)   Nothing in this section or chapter shall be construed to deprive an employee of the right to exercise any other remedy or relief provided by law.
