A nonprobationary full-time employee or attorney in the Law Department may take a leave of absence as follows:
(a) The employee shall apply in writing to their appointing authority.
(b) The appointing authority may grant a leave of absence for personal reasons and for good cause shown for up to 180 days. The employee may continue hospitalization, life insurance, and health and welfare benefits by paying the City-established monthly COBRA rate for individual or family coverage.
(c) The appointing authority may grant a leave of absence for medical reasons for up to a year upon providing medical evidence and a showing of good cause. The employee may continue to receive hospitalization, life insurance, and health care benefits by paying the employee's share of the monthly premium.
(d) The City shall grant an eligible employee up to 12 work weeks of leave per rolling calendar year as provided by the FMLA. The employee may continue to receive medical, prescription, vision, and dental insurance, by paying the employee's share of the monthly premium.
(e) An employee on an unpaid leave of absence does not accrue sick leave, vacation, longevity, or seniority.
(f) An employee may return to work before the period of approved leave expires if the appointing authority approves. If the leave was for medical reasons, the employee shall not return to work without submitting a medical certificate indicating they are fit to do so.
