151.17 LEAVES OF ABSENCE.
   Leaves of absence from employment with the City shall be available to full-time employees, salaried personnel in the Law Department and part-time court referees, for personal and medical reasons as hereinafter stated, subject to the approval of the elected official or appointing authority for whom the employee works, according to the following provisions.
   (a)   All leaves of absence and any extensions thereof shall be applied for to the elected official or appointing authority in writing by the employee on a form to be provided by the City. Any request for leave of absence shall be answered in writing within ten days from date of submission. Leaves of absence shall not be available to employees during their probationary period.
   (b)   An employee may, upon request, return to work prior to the expiration of any leave of absence, only if such early return is agreed to by the City.

   (c)   (1)   Leaves of absence granted for personal reasons may be granted for good cause shown for a period not to exceed 180 days. An employee on a personal leave of absence may continue hospitalization, life insurance and health and welfare benefits by timely paying to the City the established monthly rate for individual and/or family coverages. Employees on personal leaves of absence shall not accrue sick leave, vacation, longevity, seniority or years in service for any purpose.
      (2)   Leaves of absence for medical reasons may be granted for good cause shown and upon provision of medical evidence for a period not to exceed one year. Pursuant to the Family Medical Leave Act of 1993 (FMLA), an eligible employee shall be granted designated unpaid FMLA leave, or paid FMLA leave if earned, up to twelve work weeks per calendar year provided that thirty days advance notice is given by the employee when the leave is foreseeable. An employee on medical leave of absence shall receive hospitalization, life insurance and other employee-provided health care benefits without cost to the employee during the period of his leave of absence. An employee on medical leave of absence shall not accrue sick leave, vacation, longevity, seniority or years in service for any purpose. Any employee on this type of leave of absence shall submit a medical certificate indicating his fitness to return to employment.
