(a) A full-time employee earns 5 vacation days 1 year after being hired, except that an appointing authority may authorize up to 10 vacation days upon hire. After that, on January 1 of each year, an employee earns vacation as follows:

(b) An attorney in the Law Department earns vacation according to subsection (a), but prorated based on the number of scheduled weekly work hours.
(c) An employee shall schedule vacation with the department head's approval, and shall use vacation in at least 1 hour increments.
(d) Up to 15 of an employee's unused vacation days automatically carry over to the next calendar year. An employee forfeits unused vacation exceeding that amount.
(e) An employee promoted from a union position into non-union position may not carry over banked vacation hours to the next calendar year. The City shall pay the employee for those hours at the rate applicable before promotion.
(f) By October 1, or later if the Auditor approves, an employee may request payment for up to 10 days of unused vacation. An employee in at least their 28th year of service, including purchased military time, may request payment for up to 20 days. Every request must be for at least 5 days. If the appointing authority approves the request, the City shall pay the employee at the employee's current pay rate. If a request is based on credit for purchased military time, the employee shall submit documentation from the applicable pension board.
(g) If an employee dies, the City shall pay the employee's estate or according to law for the employee's unused vacation at the rate of pay at the time of death.
(h) The City shall pay the employee any unused vacation at the time of separation.
