(a) Nonexempt Employees.
(1) If an employee works over forty (40) hours in a workweek, the City shall credit that employee with compensatory time at a rate of one and one-half (1.5) times the hours worked unless the appointing authority authorizes the City to pay that employee overtime at a rate of one and one-half (1.5) times the hours worked.
(2) If an employee works on a holiday, the City shall credit that employee with compensatory time, at a rate of one and one-half (1.5) times the hours worked.
(3) An employee may not carry a balance of more than 120 hours of compensatory time. If an employee has 120 hours of compensatory time and works over forty (40) hours in a workweek, the City shall pay the employee overtime at a rate of one and one-half (1.5) times the hours worked.
(b) Exempt Employees.
(1) If an employee works over forty (40) hours in a workweek, the City shall credit that employee with compensatory time at the rate of one hour for every hour worked. Except as provided in subsection (b)(2), an employee may not carry a balance of more than 120 hours of compensatory time.
(2) If a general foreman, assistant supervisor of distribution, supervisor of pumping and supply, supervisor of distribution, or supervisor of filtration works over forty (40) hours in a workweek, the employee may choose to be paid at their regular rate of pay or receive compensatory time at the rate of one hour for every hour worked. The employee may not carry a balance or earn more than forty-eight (48) hours of compensatory time in a calendar year. If the employee has forty-eight (48) hours of compensatory time and works over forty (40) hours in a workweek, the City shall pay the employee at their regular rate of pay. Unused compensatory time at the end of the calendar year carries over to the next year.
(c) All Employees.
(1) An employee earns overtime and compensatory time in fifteen (15)-minute increments as follows:

(2) Hours worked includes time taken for sick leave, vacation, holiday, personal holiday, and compensatory time.
(3) An employee shall not work or use overtime or compensatory time without first getting the approval of the appointing authority or department head.
(4) An employee shall use compensatory time in at least fifteen (15)-minute increments.
(5) Upon termination of employment the City shall pay the employee for up to 120 hours of accrued compensatory time at their current regular rate of pay.
(6) An employee shall submit only overtime or compensatory time if worked in the current pay period or the one prior.
