As used in this chapter:
(a) "Approved container" or "garbage can" means a galvanized or heavy-duty rubber or heavy-duty plastic solid waste container as approved and provided to the resident by the Director of Public Service or his/her designee or a galvanized or heavy-duty rubber or a heavy-duty plastic solid waste container with a separate lid and handle(s) which has a maximum capacity of thirty-two gallons if provided by the resident. The solid waste container must be capable of retaining its structural integrity through temperature extremes.
(b) "Bulky waste" means those items whose large size precludes or complicates their handling by normal collection, processing or disposal methods.
(c) "Change of Possession" means transfer of legal title or a change in tenant.
(d) "Collection" means the act of removing solid waste from the central storage point at the source of generation.
(e) "Construction and demolition debris" or “C&D" means those materials resulting from the alteration, construction, destruction, rehabilitation, or repair on any physical structure that is built by humans, including, without limitation, houses, buildings, industrial or commercial facilities, or roadways. "Construction and demolition debris" or "C&D" includes particles and dust created during demolition activities. "Construction and demolition debris" or "C&D" does not include materials identified or listed as solid wastes or hazardous waste pursuant to Ohio R.C. Chapter 3734, and rules adopted under it; materials from mining operations, nontoxic fly ash, spent nontoxic foundry sand, and slag; or reinforced or non- reinforced concrete, asphalt, building or paving brick, or building or paving stone that is stored for a period of less than two years for recycling into a usable construction material.
(f) "CPI" or "Consumer Price Index" for purposes of this chapter means the Consumer Price Index - All Urban Consumers - U.S. City Average -All Items (current series) published by the Bureau of Labor Statistics, United States Department of Labor.
(g) "Cubic yard container" means a heavy-duty steel construction refuse container, with a capacity of at least one cubic yard or 203 gallons which meets ANSI standards and is approved by the Director of Public Service and/or his/her designee.
(h) "Dead animals" means animals that have died from any cause except those slaughtered for human consumption.
(i) "Disposal" means the orderly process of discarding useless or unwanted material.
(j) “Garbage" means putrescible wastes from the preparation, cooking and/or dispensing of food, and from the handling, storage and sale of produce.
(l) "General commercial waste" means all solid waste generated by a general commercial unit.
(m) "Generation" means the act or process of producing solid waste.
(n) "Incinerator" means an engineered apparatus used to burn waste substances and in which all the factors of combustion such as temperature, retention time, turbulence and combustion air, can be controlled.
(o) "Multi-family residential structure" means any structure, including rest homes, designed for use for residential purposes and containing four or more independent residential units, and/or, four or more residential structures, clustered in a complex and owned by the same owner.
(p) "Nonbulky waste" means any solid waste material whose nature usually prevents the containerization of such material with other residential solid waste. Nonbulky waste includes leaves, grass clippings and tree trimmings.
(q) "Open dump" means a landsite which is not a sanitary landfill and where there occurs disposal of any solid, semi-solid or liquid waste.
(r) "Person" means any individual, partnership, co-partnership, firm, company, public or private corporation, association, joint stock company, trust, estate, or any other legal representative, agent or assigns.
(s) "Processing" means any method, system or other treatment designed to change the physical form or chemical content of solid waste.
(t) "Recovered resources" means materials which still have useful physical or chemical properties after serving a specific purpose and can, therefore, be reused or recycled for the same or other purposes.
(u) "Recovery" means the process of obtaining material or energy resources from solid waste. Synonyms: extraction, reclamation, salvage.
(v) "Residential solid waste" means all solid waste that normally originates in one or more residential units.
(w) "Residential unit" means a unit arranged for the use of one or more persons, and which contains working, living, sanitary, and sleeping facilities.
(x) "Resource conservation" means the reduction of the amounts of solid waste that are generated reduction of overall resource consumption and utilization of recovered resources.
(y) "Resource recovery facility" means any facility at which solid waste is processed for the purpose of extracting, convering to energy or otherwise separating and preparing solid waste for reuse.
(z) "Resource Recovery System" means a solid waste management system which provides for collection, separation, recycling and recovery of solid wastes, including disposal of nonrecoverable waste residues.
(aa) "Sanitary landfill" means any landsite facility for the disposal of solid waste which meets the criteria of the United States Environmental Protection Agency, the rules and regulations of the Ohio Environmental Protection Agency, and has been issued, by the proper governmental authority, an operating permit.
(bb) "Single-family residential unit" means any structure designed for use for residential purposes and containing three or fewer independent residential units.
(cc) "Solid waste" means useless and unwanted material, including garbage, trash, refuse, rubbish, sewage sludge and other discarded materials with insufficient liquid content to be free flowing.
(dd) "Solid waste management" means the purposeful systematic control of the generation, storage, collection, transport, separation, processing, recovery and disposal of solid waste.
(ee) "Solid Waste Planning Authority" means the governmental agency, or its contractors, designated by the Governor of Ohio, with the authority to develop a comprehensive plan and receive federal assistance for solid waste disposal, resource recovery, resource conservation and hazardous waste management within the corporate boundaries of the City.
(ff) "Storage" means the interim containment of solid waste, in an approved manner after generation and prior to ultimate disposal.
(gg) "Source separation" means the systematic separation at the point of generation of solid waste into common types, such as glass by color, newspaper, office waste, ferrous and nonferrous metals.
(hh) "Transfer station" means a solid waste treatment facility where resources are separated, compacted and prepared in any other manner which facilitates the economic disposal of the same.
(ii) "Transport" means the movement of solid waste subsequent to collection.
(jj) "Treatment" means any method, technique or process which changes the physical, chemical or biological character or composition of solid waste, so as to neutralize such waste or render it safer and/or reduced in volume or made more amenable for storage, resource recovery or disposal. Such term includes any activity or processing designed to change the physical form so as to enhance its transport for disposal purposes.
(kk) "Uniform rate" means the rate charged for a single-family residential unit, multifamily commercial complex and commercial unit whether occupied or vacant.
