(a) The Director of Public Service shall make and enforce such rules and regulations necessary for the enforcement of the provisions of this chapter, and for the proper implementation and collection of the rates and charges for sewer services, and for the safe, efficient and economical management of the system.
(b) The Director shall specifically promulgate rules and regulations for the development of sewer charges or rates, incorporating U.S. EPA rules and regulations for user charge elements and determinations, extra strength surcharges, added charges for right-to-service users and debt retirement charges. As a minimum, such rates developed under these rules and regulations shall implement the following considerations:
(1) The system of user charges shall result in the distribution of the costs of operation and maintenance of the treatment works to each user class in proportion to such user’s contribution to the total wastewater loading of the treatment works. Factors such as strength, volume and delivery flow rate characteristics shall be considered and included as the basis for the user’s contribution to ensure a proportional distribution of operation and maintenance, including replacement, costs to each user’s class.
(2) The system of user charges shall be reviewed annually and revised periodically to reflect actual treatment works operation and maintenance costs.
(3) The system of user charges shall generate sufficient revenue to offset the costs of all treatment works operation, maintenance and such other expenditures that may be authorized.
(c) An updated copy of the rules and regulations and rate schedules implemented pursuant to this chapter shall be kept on file with the Clerk of City Council. Any changes or amendments of the rules and regulations and/or the rate schedules implemented pursuant to this chapter shall be filed with the Clerk of City Council within thirty (30) days of the effective date of such amendment or change.
