921.02 ELIGIBILITY.
   (a)   Eligibility to participate in the Cityscape Sidewalk and Curb Program is limited to properties located within the most current boundaries of the Downtown Special Improvement District or on a Downtown Gateway Corridor within the City. The City Engineer’s office and the Clerk of Council shall maintain an updated map officially identifying the areas known as the Downtown Special Improvement District and Downtown Gateway Corridors.
   (b)   Whenever the area of the Special Improvement District is expanded by action of the Board of the Special Improvement District, such expanded area shall be eligible, at the discretion of the City Council and subject to a determination that the necessary funding is available, for participation in the Cityscape Sidewalk and Curb Program. The Board of the Special Improvement District shall make application to the Director of Public Service for participation in said program. The Director of Public Service shall review said application and obtain the estimated costs of the City’s participation in the proposed Cityscape sidewalk and curb improvement for said expanded area and shall submit a written communication to City Council for approval or denial of said program to the expanded area. City Council may approve the request by informal resolution.
   (c)   In addition to the areas identified in subsection (a), properties located within the following borders shall be eligible for granite curbs:
      (1)   East - Piedmont Avenue E.
      (2)   West - Court Avenue W.
      (3)   North - 5th Street N.
      (4)   South - Tuscarawas Street.
