909.03 EXCAVATION PERMIT FEES; RESTORATION.
   (a)   The City Engineer shall, upon the filing of an application for an excavation permit, investigate the same, and if he deems it necessary, he shall issue a permit authorizing the permit holder to make excavations at the places specified.
   (b)   Fees for excavation permits are:
      (1)    Thirty-five dollars ($35.00) if the opening or excavation is to be made in an unimproved street.
      (2)    Thirty-five dollars ($35.00) if the opening or excavation is to be made in a resurfaced, stabilized or paved street.
      (3)    Five dollars ($5.00) if the excavation requires the removal of any sidewalk.
   (c)   At the time of completing any such excavation, the applicant shall restore the street to its original condition and shall remain responsible for the condition of the street surface for a period of ninety days thereafter, until it is ascertained that the excavation is stabilized.
   (d)   In the event the applicant fails to properly restore the street, the Director of Public Service is authorized to accomplish proper restoration and the applicant shall be responsible for the payment of the cost thereof to the City.
