785.04 ESTABLISHMENT LICENSE APPLICATION, ISSUANCE AND RENEWAL.
   (a)   A person desiring to operate a massage establishment shall make application to the City License Inspector upon forms prescribed by the License Inspector.
   Each application shall include a filing fee of three hundred dollars ($300.00) which shall be nonrefundable. The application shall set forth the following information:
      (1)    In the event that the applicant is an individual, the name, residence address and social security number of the applicant and of each proposed employee and massage technician to be employed by the applicant;
      (2)    In the event that the applicant is a corporation, partnership or nonprofit association, the name, position, residence address and social security number of the managing agent or employee of the applicant;
      (3)    The principal place of business of the applicant and the address of the proposed massage establishment, if different from the principal place of business;
      (4)    The name, residence address and social security number of each proposed employee and massage technician to be employed by the applicant;
      (5)    The business, occupation and employment of the applicant for a three-year period preceding the date of application; and
      (6)   Whether the applicant has been convicted of, plead no contest to, or suffered a forfeiture on a bond involving a charge of committing any crime, except minor traffic violations, within the last five years. If the answer is in the affirmative, a statement shall be made giving the place and the court in which such conviction, plea or forfeiture was had, the specific charge under which the conviction, plea or forfeiture was obtained, and the sentence imposed as a result thereof.
   (b)    The applicant shall additionally file with the City License Inspector within three working days of their occurrence any changes in the foregoing information which may occur after the filing of the application or issuance of the license, to include specifically any changes in the employees and massage technicians employed by the applicant.
   (c)   Upon application, the City License Inspector shall provide to the applicant a copy of this chapter and the applicable provisions of the City Health Code concerning massage establishments and shall obtain a signed acknowledgement from the applicant acknowledging receipt thereof.
   (d)   Upon application, the City License Inspector shall conduct an investigation into the information contained on the application and shall request the appropriate City departments to conduct an inspection of the proposed massage establishment in order to insure that it complies with the requirements of this chapter. The City License Inspector shall issue a license to operate a massage establishment to the applicant for a specific location unless the License Inspector finds:
      (1)   That the operation, as proposed by the applicant, would not be in compliance with applicable law, including, but not limited to, the Building, Health, Planning, Housing, Zoning and Fire Codes of the City, as well as the provisions of this chapter; or
      (2)    That the applicant has been convicted within the last five years of a felony; an offense involving sexual misconduct with children; keeping or residing in a house of ill fame; solicitation of a lewd or unlawful act; prostitution; pandering; or any crime involving dishonesty, fraud or deceit.
   (e)   A massage establishment license issued pursuant to this chapter shall terminate at the expiration of one year from the date of its issuance.
   (f)   A massage establishment license issued pursuant to this chapter may be renewed by the filing of a renewal application by the current holder of the license with the City License Inspector upon such forms that he may prescribe not later than thirty days prior to the expiration date of the license. A renewal application shall be accompanied by a renewal fee in the amount of one hundred dollars ($100.00).
   (g)   The issuance of a license pursuant to this section shall not exempt the applicant from obtaining a massage technician license pursuant to this chapter in the event that the applicant intends to personally provide massage services.
