705.07 PROHIBITIONS AND PENALTIES FOR FALSE ALARMS; APPEALS.
   (a)    The owner, lessor or person in possession or control of a property or premises which utilizes an alarm system shall be subject to the following provisions and penalties for false alarms occurring from premises or property under his ownership or control:
      (1)    For residential premises, for the first four (4) false alarm incidents occurring within a 365-day period, the Director of Public Safety or his designee shall notify the owner, lessor or person in possession or control of the property in writing of the occurrence of the false alarm and advise them of the provisions of this chapter concerning penalties, fines and potential civil action. Upon the occurrence of the fifth and any additional false alarms from the same location within a 365-day period, the person owning, leasing or otherwise in possession or control of a property or premises shall pay a fine of twenty-five dollars ($25.00) for each false alarm incident.
      (2)    For commercial premises, for the first two (2) false alarm incidents occurring within a 365-day period, the Director of Public Safety or his designee shall notify the owner, lessor or person in possession or control of the property in writing of the occurrence of the false alarm and advise them of the provisions of this chapter concerning penalties, fines and potential civil action. Upon the occurrence of the third and any additional false alarms from the same location within a 365-day period, the person owning, leasing or otherwise in possession or control of a property or premises shall pay a fine of fifty dollars ($50.00) for each false alarm incident.
      (3)    If any of the fines for false police or fire alarms imposed herein are not paid upon receipt of the invoice for same, or within thirty days thereafter, such fines shall be referred to the Law Director for filing in civil court.

   (b)   Any affected person may file a written appeal of the classification of an alarm as a false alarm with the Director of Public Safety within thirty days of receiving notice of same.
