A public library is hereby established in the city, located on parts of lots 8, 9 and 10 in block 98 in the Buhl townsite, under the provisions of Idaho Code title 33, chapter 26, and that for such purpose the council of the city shall annually levy and cause to be collected, as other taxes are, a tax as determined from time to time by the city council on the taxable property of said city, to constitute a library fund, which fund is hereby created, and shall be kept by the city clerk-treasurer, separate and apart from other monies of the city, and be used exclusively for personnel, the purchase of books, periodicals, computers, necessary furniture and fixtures, building maintenance, utilities, and whatever is required for the maintenance of such library. A. Appointment: For the government of such library there shall be a board of five (5) directors, all of whom shall be recommended and appointed by the council from among the citizens thereof at large that reside in the city.
B. Term: Such directors shall hold their office for five (5) years from the date of appointment and until their successors are appointed.
C. Vacancies: All vacancies shall be reported within five (5) days to the city council by the board of directors and shall be filled by appointment in the same manner as appointments are originally made. Appointments to complete an unexpired term shall be for the residue of the term only.
D. Compensation: No compensation shall be paid or allowed to any directors in any manner whatsoever. Prior approved expenses may be allowed. (1974 Code § 1-1002; amd. 2010 Code)
E. Organization:
1. Officers: The directors shall meet and organize by the election of one of their number as president, and by the election of such other officers as they may deem necessary every December at term renewal. (1974 Code § 1-1003; amd. 2010 Code)
2. Bylaws, Rules And Regulations: The directors shall make and adopt such bylaws, rules and regulations for their guidance and for the government of the library as may be expedient.
3. Control Of Expenditures: The directors shall have the exclusive control of the expenditures of all monies collected for the library fund.
4. Librarian: The directors may appoint a librarian and assistants, and prescribe rules for their conduct. (1974 Code § 1-1003)
F. Report To Idaho Commission For Libraries: The board of directors shall make an annual itemized report to the Idaho commission for libraries, formerly the Idaho state library, on or before January 1 of each year, stating the condition of their trust, and the various sums of money received from the library fund and from all sources, and how much had been expended, the number of books and periodicals on hand, and the number added by purchase, gift or otherwise, during the year, the number lost or removed, the number of books loaned out, and other statistics required by the Idaho commission for libraries. G. Authority To Accept Donations: The library board is hereby authorized to accept donations of money, personal property or real estate for the benefit of such library. Title to such property shall be vested in said board of directors to be held in control by said board, when accepted according to the terms of the deed of gifts, devise or bequest of such property said board shall be held and considered to be the special trustees. The library established under this chapter shall be forever free for the use of the residents of the city, subject to such reasonable rules and regulations as the library board may find necessary to adopt and have available for public inspection in order to render the use of the library of the greatest benefit to the greatest number, and they may exclude and cut off from use of said library any and all persons who shall wilfully violate such rules.
