ADOPTING ORDINANCE
ORDINANCE NO. 948
   AN ORDINANCE OF THE CITY OF BUHL, IDAHO, FOR REVISING, CODIFYING AND COMPILING THE GENERAL ORDINANCES OF THE CITY OF BUHL, IDAHO.
   WHEREAS, Numerous changes, additions, deletions and corrections have been made to the general ordinances of the city of Buhl, Idaho, since the publication of the last codification made by ordinance no. 583, November 5, 1974; and,
   WHEREAS, It is necessary that such ordinances be revised, codified and compiled with such changes, alterations, modifications and additions as are necessary to replace all of the ordinances of a general and permanent character in one easily accessible and ready reference manual.
   NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF BUHL, IDAHO:
   Section 1. ADOPTION OF CODE.
   The Buhl city code, 2010, perpetual looseleaf volume, consisting of all of the ordinances of the city of Buhl of a permanent and general character, with all errors, inconsistencies, repetitions and ambiguities eliminated therefrom, is hereby adopted as a code of general ordinances to be known as the Buhl city code, 2010, said ordinance or code, and all of its chapters, articles and sections are as set forth in the said code.
   Section 2. CONSTRUCTION OF CODE.
   All ordinances of a general and permanent character in force and effect as of the 8th day of February, 2010, and in conflict with the said revision, compilation and codification, adopted in section 1 hereof, are hereby repealed, subject to the following:
   (a)    All ordinances now in force and effect shall continue in force and effect for the purpose of all rights acquired, fines, penalties, forfeitures and liabilities incurred and actions therefor;
   (b)    This revised compilation and codification relates solely to the general and permanent ordinances in force and effect through ordinance no. 946 as of the 8th day of February, 2010, relating to municipal administration and ordinances enacted under the police power of said city and shall not be deemed or construed to include or to affect ordinances of a special or temporary nature, building, electric or plumbing ordinances, or codes, ordinances affecting a particular district or locality within the city limits, annexation, franchises, contract ordinances, or other ordinances of a like nature.
   Section 3. PERPETUAL LOOSELEAF CODIFICATION.
   The city of Buhl does hereby adopt as a method of perpetual codification the looseleaf ready reference manual method, each new amendment, change, addition, alteration or deletion to the Buhl city code, 2010, shall be made by the reproduction of the necessary pages for insertion in the said code within thirty (30) days after the passage of any ordinances changing said Buhl city code, 2010. The city attorney and the city clerk are hereby instructed to make such required changes as from time to time are necessitated by the passage of ordinances of a general and permanent nature. The city may keep and update the code on computer or internet accessible for the general public.
   Section 4. CODE TO BE AVAILABLE TO GENERAL PUBLIC.
   At least two copies of the code shall be kept at the city clerk's office. Said copies shall be available to the general population for reading, research and copying. The clerk shall charge the cost of copies on a per page basis adopted by the clerk to meet the city's cost of such copies.
   Section 5. EFFECTIVE DATE.
   Buhl city code, 2010, shall be in full force and effect from and after the 16th day of July, 2010.
