§ 150.04 DEFINITIONS.
   For the purposes of this chapter, the following definitions are added to give additional clarification to definitions set out in I.C. 36-7-9:
   DEPARTMENT. The Brownsburg Development Services Department.
   ENFORCEMENT AUTHORITY. The enforcement authority to enforce the provision of this subchapter as well as those provision adopted by reference shall be the Town of Brownsburg’s Building Commissioner or their designee.
   HEARING AUTHORITY. The Town of Brownsburg Town Council.
   SUBSTANTIAL PROPERTY INTEREST. Any right in real property that may be affected in a substantial way by actions authorized by this chapter, including a fee interest, a life estate interest, a future interest, a mortgage interest, or an equitable interest of a contract purchaser.

§ 150.05 STANDARD FOR THE SEALING OF VACANT AND/OR ABANDONED BUILDINGS.
   (A)   To protect the building against unlawful entry or vandalism, while vacant, the owner may secure the doors and windows of the building by the use of boarding. Doors may be secured against unlawful entry by the use of locks designed to prevent unlawful entry.
   (B)   If boarding is used to secure the building compliance with the following standard is required:
      (1)   Windows shall be framed by nominal two-inch (2") by four-inch (4") lumber secured with plywood to the frame using six (6) seven-inch (7") lag bolts into king studs in all corners and in the center of the vertical boards. Plywood shall be a minimum of 4-ply rated for exterior exposure, no less than one-half inch (½") in thickness and attached with tamper proof screws, no less than three-inches (3") in length and spaced no more than eight-inches (8") on-center.

      (3)   The Building Commission may authorize an alternate method to secure windows and doors upon presenting the following information:
         (a)   Type of material(s).
         (b)   Thickness of material.
         (c)    Method used to attach materials to building or structure.
   (C)   (1)   Boarding is to be considered temporary and not a long-term method of securing the building.
      (2)   Boarding used to secure doors and/or windows for more than ninety (90) days shall be surface coated with an exterior grade paint matching the exterior of the building. By matching the exterior of the building reduces the blighting effect.

§ 150.06 UNSAFE BUILDING FUND.
   The Enforcement Authority in accordance with I.C. 36-7-9 shall establish within its operating budget a fund designated as the Unsafe Building Fund. Said fluid shall be administrated in accordance with I.C. 36-7-9.

§ 150.07 PENALTY FOR VIOLATION.
   Violations of this subchapter shall be addressed as established in I.C. 36-7-9, as it may be amended from time to time.

BUILDING CODE
§ 150.35 COMPLIANCE REQUIRED.
   The provisions of this subchapter apply to the construction, alteration, repair, use, occupancy, and addition to all buildings and structures, other than industrial building systems or mobile structures certified under I.C. 22-15-4, in the jurisdiction of the Town Advisory Plan Commission.

§ 150.36 ISSUANCE OF PERMITS.
   No permit required by this subchapter shall be issued unless the application for a permit is accompanied by a plat or sketch of the proposed location showing lot boundaries, and by plans and specifications showing the work to be done. All plans for building construction under the authority of the Fire Prevention and Building Safety Commission of the State must also be filed in accordance with state law and regulations. In addition, a copy of a design release, issued by the State Building Commissioner and the State Fire Marshal pursuant to I.C. 22-15-3-1, shall be provided to the Building Commissioner before issuance of a permit for construction covered by the design release.
