REGULATIONS
§ 97.01 DEFINITIONS.
   For the purposes of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   AQUATIC FACILITY. Any natural or man-made facility used for the purpose of swimming, bathing, boating, and including all forms of aquatics or aquatic related activities.
   BUILDING or STRUCTURE. Any facility or building of permanent or temporary construction used for the purpose of leisure activities, or storage, maintenance, and other related usage in the operation of the Department of Parks and Recreation.
   DIRECTOR. A person immediately in charge of any park area and recreational activity and facility and to whom all park and or recreational staff and employees are responsible.
   PARK. A park, reservation, playfield, playground, tot lot, multipurpose area, ballfield, tennis court, basketball area, and all other open space area in or out of the city, owned or used by the city, and devoted to active or passive leisure.
   PERSON. Any person, firm, partnership, association, corporation, company, or organization of any kind.
   VEHICLE. Any wheeled conveyance, whether motor-powered, animal-drawn, or self-propelled, including any trailer in tow of any size, kind, or description, and excluding baby carriages and vehicles in the service of the city parks.

§ 97.02 PARK PROPERTY.
   No person in the park shall perform any of the following acts.
   (A)   Buildings and other property.
      (1)   Disfiguration and removal. Willfully mark, deface, disfigure, injure, tamper with, displace, or remove any buildings, bridges, tables, benches, fireplaces, railings, paving or paving material, water lines or other public utilities or part or appurtenances thereof, signs, notices or placards, whether temporary or permanent, monuments, stakes, posts or appurtenances, either real or personal.
      (2)   Restrooms and washrooms. Fail to cooperate in maintaining restrooms and washrooms in a neat and sanitary condition. No person over the age of five years shall use the rest rooms and washrooms designated for the opposite sex.
      (3)   Removal of natural resources. Dig or remove any sand, or any soil, rock, stones, trees, shrubs or plants, downtimber or other wood or materials, or make any excavation by tool, equipment, blasting, or other means or agency without the permission of the Director.
      (4)   Erection of structures. Construct or erect any building or structure of whatever kind, whether permanent or temporary in character, or run or string any public service utility into, upon, or across such lands, except on special written permit hereunder approved by the Director.
      (5)   Confetti, balloons, animals, birds and insects. Transport into the parks, release in the parks or attach to park flora or facilities confetti, balloons, wild animals, birds or insects or allow domesticated animals access to the parks except in such areas and in such manner as designated by the Director.
   (B)   Trees, lawns, landscaping, and natural areas.
      (1)   Injury and removal. Damage, cut, carve, transplant, or remove any tree, plant, or species of mushroom, or injure the bark or pick the flowers or seeds of any tree or plant. Nor shall any person attach any rope, wire, or other contrivance to any tree or plant. No person shall dig in or otherwise disturb grass areas or in any other way injure or impair the natural beauty or usefulness of any area. Vegetation management activities as approved by the Director are permitted.
      (2)   Climbing trees and the like. Climb any tree, pull on branches to excess, or walk, stand, or sit upon monuments, vases, fountains, railings, fences, or picnic tables, or upon any other property not designated or customarily used for such purposes.
   (C)   Wild animals or birds.
      (1)   Hunting. Hunt, molest, harm, frighten, kill, trap, chase, tease, shoot, or throw missiles at any animal, reptile, amphibian, non-pest species of insect or bird. No person shall remove or have in his or her possession the young of any wild animal, or the eggs, nest, or young of any amphibian, reptile, non-pest species of insect or bird; nor shall he or she collect, remove, have in his or her possession, give away, sell or offer to sell, buy or offer to buy, or accept as a gift, any animal specimen alive or dead.
      (2)   Feeding. Give or offer or attempt to give to any wildlife or domestic animal any tobacco, alcohol, or other known noxious substances or offer food to wildlife unless specifically authorized by the Director.

§ 97.03 SANITATION.
   No person in a park shall perform any of the following acts.
   (A)   Pollution of waters. Throw, discharge, or otherwise place or cause to be placed in the waters of any fountain, wetland or body of water in or adjacent to any park or tributary, stream, storm sewer, or drain flowing into such water, any substance, matter, or thing, liquid or solid, which will or may result in the pollution of such water.
   (B)   Refuse and trash. Have brought in or dump, deposit, or leave any bottles, broken glass, cigarette butts, ashes, paper, boxes, cans, dirt, rubbish, waste, garbage, or refuse or other trash. No such refuse or trash shall be placed in any waters in or contiguous to any park or left anywhere on the grounds thereof, but shall be placed in the proper receptacles where these are provided; where receptacles are not so provided, all such rubbish or waste shall be carried away from the park by the person responsible for its presence and properly disposed of elsewhere.

§ 97.04 TRAFFIC.
   No person in a park shall perform any of the following acts.
   (A)   State motor vehicle laws. Fail to comply with all applicable provisions of the state motor vehicle traffic laws in regard to equipment and operation of vehicles together with such regulations as are contained in this chapter and other ordinances.
   (B)   Enforcement of traffic regulations. Fail to obey all traffic officers and park employees, such persons being hereby authorized and instructed to direct traffic whenever and wherever needed in the parks and on the highways, streets, or roads immediately adjacent thereto in accordance with the provisions of these regulations and such supplementary regulations as may be issued subsequently by the Director.
   (C)   Traffic signs. Fail to observe carefully all traffic signs indicating speed, direction, caution, stopping, or parking, and all others posted for proper control and to safeguard life and property.
   (D)   Speed of vehicles. Ride or drive a vehicle at a rate of speed exceeding 15 miles per hour except upon such roads as the Director may designate, by posted signs, for speedier travel.
   (E)   Operation confined to roads. Drive any vehicles on any area except the paved park roads or parking areas or such other areas as may on occasion be specifically designated as temporary areas by the Director.
   (F)   Parking.
      (1)   Designated areas. Park a vehicle in other than an established or designated parking area. Such use shall be in accordance with the directions there posted, and with the instructions of any attendant who may be present.
      (2)   Full-parking. Block the road or driveway at any time. In order to enjoy some special natural scenic feature, vehicles may be parked with the two left wheels near the right edge of the paving for not more than five minutes. No stopping or parking is permitted, even briefly, on the left-hand side of any road or driveway.
      (3)   Immovable vehicles. Leave any vehicle anywhere in the park with one or more wheels chained or in a nonmovable status.
      (4)   Night parking. Leave a vehicle standing or parked at night without lights clearly visible for at least 100 feet from both front and rear on any driveway or road area, except legally established parking areas or park overnight without the written permission of the Director.
      (5)   Emergency procedure. Fail to immediately notify the Director, staff, police dispatcher, or police officer of an emergency in the nature of a breakdown requiring the assistance of a tow truck or mechanic.
      (6)   Double parking. Double park any vehicle on any road or parkway unless directed by a park official.
      (7)   Muffler required. Fail to use a muffler adequate to deaden the sound of the engine in a motor vehicle.
   (G)   Bicycles.
      (1)   Confined to roads. Ride a bicycle on other than a paved vehicular road or path designated for that purpose. A bicyclist shall be permitted to wheel or push a bicycle by hand over any grassy area or wooded trail or on any paved area reserved for pedestrian use.
      (2)   Operation. Ride a bicycle on other than the right-hand side of the road paving, as closely as conditions permit. Bicycles shall be kept in single file when two or more are operating as a group. Bicyclists shall at all times operate their machines with reasonable regard to the safety of others, signal all turns, pass to the right of any vehicle they are overtaking, and pass to the right of any vehicles they may be meeting.
      (3)   Rider prohibited. Ride any other person on a bicycle unless such conveyance has been specifically built for a second person.
      (4)   Designated racks. Leave a bicycle in a place other than a bicycle rack when such is provided and there is a space available.
      (5)   Immobile. Leave a bicycle lying on the ground or paving, or set against trees, or in any place or position where other persons may trip over or be injured by it.
      (6)   Night operation. Ride a bicycle on any road in the park after sunset or before sunrise without an attached headlight plainly visible at least 200 feet in front and without a red taillight or red reflector plainly visible from at least 100 feet from the rear of such bicycle.

§ 97.05 RECREATIONAL ACTIVITIES.
   No person in a park shall perform any of the following acts.
   (A)   Bathing and swimming.
      (1)   Designated areas. Swim, bathe, or wade in any waters or waterways in or adjacent to any park, except in such waters and at such places as are provided therefor, and in compliance with such regulations as are herein set forth or may be hereafter adopted. Nor shall any person frequent any waters or places customarily designated for the purpose of swimming or bathing, or congregate thereat when such activity is prohibited by the Director upon a finding that such use of the water would be dangerous or otherwise inadvisable.
      (2)   Certain hours. Frequent any waters or places designated for the purpose of swimming or bathing, or congregate thereat, except between such hours of the day as shall be designated by the Director for such purposes for each individual area.
      (3)   Bathing attire. Allow themselves to be so covered with a bathing suit as to indecently expose his or her person or call forth merited criticism.
      (4)   Bathhouses. Dress or undress in any vehicle, toilet, or other place, except in such bathing houses or structures as may be provided for that purpose.
   (B)   Fishing; general prohibition. Fish in any waters, whether by the use of hook and line, net, trap, or other device, except in waters designated by the Director for that use and under such regulations and restrictions as have been or may be prescribed by the Director.
   (C)   Hunting and firearms. No person shall hunt, trap, or otherwise pursue wildlife within park property, nor shall any person use, carry, or possess within park property any form of weapon in violation of the Ohio Revised Code.
   (D)   Picnic areas and use.
      (1)   Regulated. Picnic or lunch in a place other than those designated for that purpose. Attendants shall have the authority to regulate the activities in such areas when necessary to prevent congestion and to secure the maximum use for the comfort and convenience of all. Visitors shall comply with any directions given to achieve this end.
      (2)   Availability. Violate the regulation that use of the individual grills together with tables and benches follows generally the rule of “first come, first served” unless a reservation has been made and paid for under the guidelines established by the Director for such purpose.
      (3)   Nonexclusive. Use any portion of the picnic areas or any of the buildings or structures therein for the purpose of holding picnics to the exclusion of other persons, nor shall any person use such area and facilities for an unreasonable time if the facilities are crowded unless such person obtained a reservation permit for such area or facility.
      (4)   Duty of picnicker. Leave a picnic area before a fire is completely extinguished and before all trash in the nature of boxes, papers, cans, bottles, garbage, and other refuse is placed in the disposal receptacles where provided. If no such trash receptacles are available, refuse and trash shall be carried away from the park area by the picnicker to be properly disposed of elsewhere.
   (E)   Camping. Set up tents, shacks, or any other temporary shelter for the purpose of overnight camping unless permitted by the Director; nor shall any person leave in a park after closing hours any movable structure or special vehicle to be used or that could be used for such purpose, such as house trailers, camp trailers, camp wagons, or the like, without permission of the Director.
   (F)   Games. Take part in or abet the playing of any games involving thrown or otherwise propelled objects such as balls, stones, arrows, javelins, or model airplanes, except in areas set apart for such forms of recreation. The playing of rough or comparatively dangerous games such as football, baseball, is prohibited except on the fields and courts or areas provided therefor. Roller skating and roller blading shall be confined to those areas specifically designated for such pastime.
