9-11-1: PURPOSE:
The purpose of this chapter is to provide a just, equitable and practical method, to be cumulative with and in addition to, any other remedy provided by this Code, or otherwise available at law, whereby buildings or structures which, from any cause, endanger the life, limb, health, property, safety or welfare of the general public or their occupants, may be required to be repaired, vacated or demolished. 9-11-2: ABATEMENT OF DANGEROUS BUILDINGS CODE ADOPTED:
All the rules, regulations and ordinances of a general and permanent character relating and applying to the repair, vacation or demolition of buildings endangering life, limb, health, property, safety or welfare of the general public or their occupants shall be governed by the Uniform Code for the Abatement of Dangerous Buildings, the 1997 edition, printed and published under the authority of the International Conference of Building Officials. Copies of the Uniform Code for the Abatement of Dangerous Buildings duly certified by the City Clerk are on file in the Office of the City Clerk for use and inspection. (1952 Code § 4-11-02)
9-11-2-1: PRECEDENCE:
Certain provisions of the Uniform Code for the Abatement of Dangerous Buildings, hereinafter referred to as "ADB", have been amended by the City and shall take precedence over the ADB. (1952 Code § 4-11-02.01)
9-11-3: AMENDMENT OF ADB, VIOLATIONS, SECTION 203:
Section 203 of the ADB is amended to read as follows:
Violations And Penalties. No person, firm or corporation whether as owner, lessee, sublessee or occupant, shall erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use, occupy or maintain any building or premises, or cause or permit the same to be done, contrary to or in violation of any of the provisions of the Uniform Code for the Abatement of Dangerous Buildings and the Boise City Code.
Criminal Penalties. Any person, firm or corporation violating the provisions of this Code shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not more than one thousand dollars ($1,000.00), by imprisonment for not more than one hundred eighty (180) days or by both such fine and imprisonment. Each separate day or any portion thereof during which any violation of this Code occurs or continues shall be deemed to constitute a separate offense and, upon conviction thereof, shall be punishable as herein provided.
Civil Penalties. Any person, firm or corporation violating any provision of this Code may have civil penalties assessed against them. A new violation may be filed for each day the violation continues. The violation will have a date when the violation shall be paid by, if it is not paid by that date, the City shall pursue collections through court and will ask the court to reimburse for all costs and fees associated with collecting the penalty. Any person who violates any provision of this Code shall be subject to a civil penalty of not more than two hundred dollars ($200.00) for the first offense and a civil penalty of not more than one thousand dollars ($1,000.00) for each offense thereafter.
