§ 111.04 INSPECTIONS.
   (A)   Police officers are authorized to check all liquor establishments for possible violations.
   (B)   Fire, Health and Building Inspectors shall make inspections for compliance as required, to protect public safety and health, with applicable Fire, Health and Building Codes and regulations and submit a written report thereof to the Mayor.

§ 111.05 SIGNS.
   (A)   Display signs. No display or advertisement signs, located either inside or outside of the licensed premises, shall be illuminated or otherwise lighted during the closing hours as provided for in this chapter.
   (B)   Display of birth defects warning signs. Every holder of a retail license, whether the licensee sells or offers for sale alcoholic liquors for use or consumption on or off the licensed premises, shall cause a sign with the message “GOVERNMENT WARNING: ACCORDING TO THE SURGEON GENERAL, WOMEN SHOULD NOT DRINK ALCOHOLIC BEVERAGES DURING PREGNANCY BECAUSE OF THE RISK OF BIRTH DEFECTS” to be framed and hung in plain view. These signs shall be a minimum of eight and one-half inches by 11 inches.

§ 111.06 NON-CONFORMING USES.
   (A)   It is the intent of this section to provide for the regulation of non-conforming uses under this chapter and to specify those circumstances and conditions under which non-conforming uses shall be accepted or shall gradually be eliminated.
   (B)   Any business which existed lawfully at the time of the adoption of this chapter and which remains or becomes non-conforming upon the adoption of this chapter, or any subsequent amendment thereto, may continue only in accordance with the following regulations.
      (1)   Repairs and alterations. Ordinary repairs and alterations may be made to non-conforming use business; provided that, no structural alterations shall be made to the premises, except those required by law, or except to make the premises or structure and use thereof conform to the regulations of the zoning district in which it is located. Any other alterations or repairs are subject to approval of the City Council.
      (2)   Reolcation. Relocation of the business to another location must conform to this chapter at the new location as well as the previous non-conforming location.
      (3)   Abandonment. Abandonment of the business will occur if the current licensee fails to renew such license as prescribed hereunder and may only reapply for such license that conforms to the regulations of this chapter.
      (4)   Conviction. Conviction of any offense, by any agency or court having legal jurisdiction, that would cause a license denial of a new applicant by any owner, partner or their agents must conform to this chapter and renewal of non-conforming use(s) shall not be allowed.
      (5)   Failure. Failure to comply with any other city ordinance or laws applicable to the business will require conformity with this chapter no later than the next renewal period.

§ 111.07 EFFECTIVE DATE.
   This chapter shall be in full force and effect from and after its passage and publication as provided by law.

PROHIBITED CONDUCT; OPERATIONS
§ 111.20 UNDERAGE DRINKING AND VIOLATIONS; MINORS.
   (A)   (1)   It shall be unlawful for any owner, agent or employee of any premises to knowingly allow any person under the age of 21 years to violate any provisions of this chapter.
      (2)   It shall be unlawful for any parent or guardian to knowingly suffer or permit any person under the age of 21 years of which he or she may be the parent or guardian to violate any provisions of this chapter.
   (B)   No person under the age of 21 shall be permitted within the premises of any liquor establishment licensed for the consumption of alcohol on the premises, other than restaurants or banquet type facilities or, unless he or she is with his or her parents or legal guardian.

§ 111.21 CONSUMPTION OR POSSESSION ON PUBLIC WAY, PARKING LOT.
   It shall be unlawful for any person to drink, consume, transport, carry or possess any alcoholic liquor, except in the original package and with the seal unbroken, on a public street, sidewalk, parkway, public parking lot or semi-public parking lot. The term SEMI-PUBLIC PARKING LOT shall include any area wherein motor vehicles are parked by the public in conjunction with any business, enterprise, commercial establishment or multi-family residence.
