731.04 DETERMINING PUBLIC CONVENIENCE AND NECESSITY.
   No license for the operation of taxicabs in excess of the limitation prescribed by Section 731.03 shall be issued unless and until Council shall by resolution declare that public convenience and necessity require the issuance of additional taxicab licenses in the number set forth in such resolution. Upon the passage of such resolution, the City Manager shall be authorized to issue the specified additional number of taxicab licenses.
   Before the adoption of such resolution, Council shall provide for such public hearings, notice of the date of which shall be given to all existing licensees, as may be necessary to determine whether public convenience and necessity require the issuance of such licenses and the number of public vehicles in respect to which licenses should be issued. In determining whether public convenience and necessity require the issuance of any such licenses, Council shall take consideration:
   (a)   The number of public vehicles then licensed;
   (b)   Whether the requirements of public convenience and necessity can be met and complied with only by the issuance of such license or of any additional license;
   (c)   The resulting effect upon the business of existing licenses and upon the existing agencies of mass transportation;
   (d)   The effect on traffic congestion and safety of the public using the streets;
   (e)   The effect upon working conditions and wages or other compensation paid to drivers of public vehicles of existing licensees;
   (f)   The financial responsibility of the applicant;
   (g)   The character of the applicant;
   (h)   Any other factors which Council may deem relevant.
   In the event Council shall determine that public convenience and necessity require the issuance of any additional license, holders of existing licenses shall be given the opportunity to furnish any additional service in respect to which the claim is asserted that the licensing of additional public vehicles is required, and Council shall not authorize the issuance of any additional license unless existing licensees shall, within a time stipulated in the resolution, fail to provide the required additional service.
