         (a)   To qualify for this user class, the entity must be a public water supplier as defined by OEPA serving a customer base outside the service area of the village.
         (b)   1.   Fees will be based on the capacity volume guaranteed to the water supplier.
            2.   The actual volume purchased will be reviewed on an annual basis to determine peak and average demand.
            3.   Should the seasonal average daily volume in any calendar year exceed the guaranteed capacity by more than 10%, additional capacity fees shall be assessed.
         (c)   Minimum billings will require payment of 80% of the purchased capacity for the first five years, should actual demand fall below the 80% threshold. After this five-year interval, the water will be billed based on actual consumption. All water billed will be at the lowest rate in effect at the time of usage.
         (d)   Capacity purchased under this class is based on availability and is purely at the discretion of the Council of the village.
      (2)   User class; commercial, industrial, food service.  Industrial, commercial and food service system capacity charges based on water meter size.

§ 50.03  PAYMENT PRIOR TO PERMIT ISSUANCE.
   The foregoing tap-in charges shall be paid by the applicant property owner prior to the issuance of a tap-in permit by the Village Administrator for connection to the sanitary sewerage system of the village.

§ 50.04  TAP-IN FEES TO RUN WITH THE LAND; NO REFUNDS.
   (A)   All water and sewer tap-in fees hereafter collected in full payment of the schedule of such fees shall run with the land for a period of five years from the date issued, and shall pass to subsequent owners of the land for which the fee was paid, and the tap-in may be made within the five-year period. If no tap-in is made within that period, a new tap-in fee must be paid in accordance with the schedule in force at the time that the new application for a tap-in is made.
   (B)   All water and sewer tap-in fees collected in full payment of the schedule of such fees prior to the effective date of this section shall run with the land and shall pass to subsequent owners of the land for which the fee was paid, and the tap-ins may be made at any time, for the reason that Council believes that Ohio Constitution Art. II, § 28 prohibits the passing of retroactive laws.
   (C)   There being no provision in any previous ordinance permitting refund of tap-in fees paid for, but not used by the applicant, it is now hereby ordained that no such refund shall be made.

§ 50.05  DELINQUENT PAYMENT; PENALTY AND COLLECTION WITH OTHER TAXES.
   (A)   The bill for any services rendered by the waterworks system or the sewerage system shall be paid by the fifteenth day of each month and if not so paid a 6% late fee shall be added to such bill and if not paid with penalty as provided in § 50.06, such water services shall be cutoff as provided in § 50.06 and services shall be resumed only upon compliance with § 50.06. If such bill remains unpaid for a period of 60 days, it shall be certified over to the County Auditor and collected at the same time and in the same manner as all other taxes as provided by law. When the fifteenth of the month, which is the last day for payment of the water, sewer and waste collection bills, falls on a Saturday, Sunday or a holiday, the payment is due by the close of the next working day.
   (B)   A $15 fee will be charged on returned checks.  The county policy is hereby by adopted.

§ 50.06  DISCONNECTION FOR LATE PAYMENT.
   (A)   It is the policy of the village to discontinue utility service to customers by reason of nonpayment of bills only after notice and a meaningful opportunity to be heard on disputed bills. The village’s form for application for utility service and all bills shall contain, in addition to the title, address, room number and telephone number of the official in charge of billing, clearly visible and easily readable provisions to the effect:
      (1)   That all bills are due and payable on or before the date set forth on the bill;
      (2)   That if any bill is not paid by or before that date, a second bill will be mailed containing a cutoff notice that if the bill is not paid within ten days of the mailing of the second bill, service will be discontinued for nonpayment; and
      (3)   That any customer disputing the correctness of his or her bill shall have a right to a hearing at which time he or she may be represented in person and by counsel or any other person of his or her choosing and may present orally or in writing his or her complaint and contentions to the village official in charge of utility billing. This official shall be authorized to order that the customer’s service not be discontinued and shall have the authority to make a final determination of the customer’s complaint.
   (B)   The Mayor or Village Administrator may waive charges for good cause, which the official shall document. In the absence of payment of the bill rendered or resort to the hearing procedure provided herein, service will be discontinued at the time specified, but in no event until the charges have been due and unpaid for at least 30 days.
   (C)   When it becomes necessary for the village to discontinue utility service to a customer for nonpayment of bills, service will be reinstated only after all bills for service then due have been paid, along with a turn-on charge as established by § 53.02.

§ 50.07  APPLICATION OF PARTIAL UTILITY BILL PAYMENTS; PROCEDURES FOR ADDRESSING CUSTOMER BANKRUPTCY PETITIONS.
   (A)   The Village Fiscal Officer is directed to apply utility payments received from an individual, commercial or industrial user (customer) as follows:
      (1)   First to payment of the garbage or trash charges for the immediate month;
      (2)   Second to the payment of the sewer charges for the immediate month;
      (3)   Third to the payment of the water charges for the immediate month; and
      (4)   Fourth to any other charges appearing on the account billing.
      (5)   Fifth to any NSF or late charges accrued on the account;
   (B)   In the event that the village shall receive a notice that a user (customer) has filed a bankruptcy petition, the Village Administrator shall immediately calculate the utility charges for said user to the date of the bankruptcy petition and shall create a new account for future service to said user. The user shall be required to place a deposit on the new account as provided for in the Administrative Code. Services provided to the new account shall be governed by the standard procedures in the Village Administrative Code.

§ 50.08  WATER MANAGEMENT AND SEDIMENT CONTROL REGULATIONS.
   (A)   The Water Management and Sediment Control Regulations, copies of which are on file in the village offices, is adopted and incorporated as part of this code of ordinances as fully as if set out at length herein.
   (B)   The Administrator of the village is hereby authorized to enter into the agreement regarding administration and enforcement of the Village Water Management and Sediment Control Regulations with the county.
