   (a)   No person shall place or dispose of in any manner any garbage, waste, rubbish, ashes, cans, bottles, wire, paper, furniture, glass, oil or anything else of an unsightly or unsanitary nature, upon any lot or land in the City, except upon land designated by ordinance, nor shall the same be placed or disposed of along or near any public street or highway within the City. The owner, lessee or manager of any premises shall have 15 days, after being notified by the Police Department, to dispose of such garbage, refuse or junk. Such notice by the Department and the 15-day grace period following thereafter are not necessary in the case of a repeat or habitual offender under this subsection.

   (b)   No person shall, regardless of intent, without lawful authority, place or dispose of in any manner, or cause to be placed or disposed of in any manner, upon any public real property or upon the real property of another, any paper, trash, garbage, waste, rubbish, refuse, junk, animal excrement or any substance or material which is or may become noxious, offensive, injurious or dangerous to the public health, safety or welfare.

   (c)   Whoever violates any of the provisions of this section is guilty of a misdemeanor of the fourth degree for a first offense. For a second offense within one year after the first offense, such person is guilty of a misdemeanor of the third degree. For a third offense within one year after the first offense, such person is guilty of the misdemeanor of the second degree. The penalty shall be as provided in Section 698.02.
