(A) The Council hereby declares and finds that there is all ever increasing need for fees to be levied in order to alleviate the cost of specific public works projects necessitated by each development. Such developments create the need, among other things, for increased traffic light and street improvements, street lighting facilities, and many other facilities not here specifically mentioned.
(B) Such development has created the need for these facilities, and it is the purpose of this chapter to create and impose various fees upon such develop-ment which will alleviate the cost of providing such facilities for that development.

(A) No building permit shall be issued for any new building designed for a residential, commercial, industrial, institutional, or related use, pursuant to the provisions of this code, nor shall any person, firm, or corporation do or perform any act or thing, the doing or performance of which requires a building permit under the provisions of this code, unless the payment of a traffic signalization fee has been made as set forth in this chapter.
(B) Fees shall be based on the general number of traffic trips generated by the type of development to be built all in accordance with the Master Signalization Facilities Plan and fee schedule which shall be adopted by the Council by resolution and which may be amended from time to time.

Signalization facilities fees as adopted by the Council shall not be required in the following situations:
(A) Residential. No fee shall be required as a condition of the issuance of a building permit for residential accessory buildings, unless the cost of construction exceeds 75% of the then present market value (based upon the last equalized assessment role of the county) of the existing improvements on the property.
(B) Industrial, commercial, and institutional. Where the fee for an industrial, institutional, or commercial area cannot be determined by the fee schedule as adopted by the Council, the Council, upon the making of appropriate findings, shall set a fee, after a recommendation from the City Engineer, consistent with the purpose and intent of this chapter, § 7-5.02 of this chapter, and the Master Signalization Facilities Plan.
(C) One-time charge. In any case where a fee has been collected for a development based on the provisions of this section and § 7-5.02 of this chapter, no further fee pursuant to this chapter shall be required for such development for which a fee was paid.
