155.05 RESPONSIBILITIES OF PROPERTY OWNERS.
   (a)   Generally. The owner of any lot or parcel of land in the City is responsible for the care and maintenance of trees located on their property that may affect adjacent public thoroughfares, including streets and sidewalks, as set forth herein and in Section 921.01 of the Codified Ordinances.
   (b)   Responsibilities and Duties. Property owners shall keep trees trimmed and property maintained so that:
      (1)   Dead, decaying or broken branches do not overhang the sidewalk or street;
      (2)   Tree branches do not obstruct the passage of light from any street lamps to the street or sidewalk;   
      (3)   There is a clearance of at least eight (8) feet above the surface of any sidewalk;
      (4)   There is a clearance of at least fourteen (14) feet above the surface of any street.   
   (c)   Powerlines. Property owners shall not attempt to clear branches or vegetation near power lines.
   (d)   Public Plantings. No person shall plant any tree or shrub upon any public way, public area, street, or alley unless he or she shall have first obtained a permit in writing from the Parks and Recreations Department specifying the size, type, species, and location on the public way, public area, street, or alley of the tree or shrub to be planted.
