1744.03 LICENSE REQUIREMENTS.
   The Health Commissioner or his designee shall issue licenses to those operators of proposed group homes, who submit the following:
   (a)    A valid zoning permit;
   (b)    The written approval of the Fire Chief, issued after inspection for compliance with the Fire Code applicable to the facility;
   (c)    The written approval of the Chief Building Official, issued after inspection for compliance with the Building Code;
   (d)    The written approval of the supervisors of all appropriate inspection divisions, issued after inspections for compliance with the Health Code (s);
   (e)    A letter of intent to provide the City Police Department with current emergency contact information;
   (f)    An application form containing the following:
      (1)    The name(s), address(es), and telephone number(s) of:
         A.    The owner(s) of the property on which the group home is located;
         B.    The operator(s) of the group home;
      (2)    The maximum number of individuals to reside in the facility, the general nature of their needs, and the assistance to be provided them;
      (3)    The name by which the group home shall operate;
      (4)    A typewritten copy of the rules of the group home, along with a statement of the level of supervision that is to be provided, and the rules for the storing and taking of medication. Each resident of the group home shall also be provided with a copy of such rules should they so request.
      (5)    A statement of admission procedures and policy.
      (6)    Signed authorization allowing the Health Commissioner to conduct a criminal background check.
   (g)    The qualifications of each individual named in an application for a license shall be considered separately by the Health Commissioner and if any one named individual is deemed unqualified, the application shall be denied.
   (h)    Grounds for denial of applications by the Health Commissioner may include but shall not be limited to, the following:
      (1)    Conviction of a felony;
      (2)    The conviction of a misdemeanor involving moral turpitude;
      (3)    Drug abuse or addiction;
      (4)    Excessive use of alcohol or other intoxicants; or
      (5)    Any other conduct which threatens or adversely affects the safety and/ or general welfare of the residents.
      (6)    Failure to provide any of the information required in an application for a license or the renewal thereof, or providing false or misleading information may be grounds for immediate revocation.
   (i)    Such additional information as the Chief Building Official deems necessary to preserve the health, safety and welfare of the group homes' residents and the public, consistent with the provisions of this chapter, providing such information does not infringe upon the residents' rights of personal privacy. However, a signed medical release for information form shall be required of all applicants. Such medical information will be considered confidential and may not be used as the sole reason for denial of a license.
   (j)   Payment of a nonrefundable fee for each new license or for each renewal of a license as follows:
      (1)   Small group home (3 to 5 residents); $60.00
      (2)    Medium group home (6 to 10 residents); $100.00
      (3)    Large group home (11 to 16 residents); $150.00
   (k)    If applicable, State license, certification or approval or evidence that same is forthcoming from the applicable State governmental body.
      (1)    A certificate of occupancy as required by City Zoning Ordinance issued by the Zoning Analyst or authorized agent; except that, a group home established under Ohio R.C. 5123.18 shall be required only to be inspected and approved for compliance with the Building and Fire Prevention Codes.
