1737.99 PENALTY.

Whoever violates any provision of this chapter is guilty of a minor misdemeanor for the first offense and for any subsequent offense is guilty of a misdemeanor of the second degree, provided that the affidavit upon which the prosecution is instituted contains the allegation that the offense is a second or repeated offense, otherwise, the prosecution shall always be as for a first offense.
