737.99 PENALTY.
   Whoever violates Sections 737.02 through 737.09 is guilty of a misdemeanor of the third degree for the first offense and a misdemeanor of the second degree for each subsequent offense.
   Whoever violates Section 737.10 is guilty of an unclassified misdemeanor, punishable by up to six months incarceration and a fine of up to one thousand dollars ($1,000), or both. The willingness of the defendant to perform community service in the Litter Control Department may be considered as a mitigating factor in sentencing. The Court shall require the offender to pay restitution to the City for the cost of the removal or abatement of the nuisance and cleanup of the site where the offense occurred, if the City of Youngstown has performed the function.
