547.31 RESPONSIBILITIES OF CITY DEPARTMENTS AND CONTRACTORS.

   (a)   Each agency or department of the City of Youngstown shall, unless otherwise determined by the Commission, pursuant to Section 547.33:

      (1)   Award its construction contracts consistent with a goal of twenty percent (20%), or such goal as may be determined by the Mayor, of the dollar volume of all construction contracts to be let to minority business enterprises and award its construction contracts consistent with a goal of two percent (2%), or such goal as may be determined by the Mayor, of the dollar volume of all construction contracts to be let to female business enterprises.

      (2)   Award its procurement of goods and services other than construction consistent with a goal of five percent (5%), or such other goals as may be determined by the Mayor, of the dollar volume to minority business enterprises and award its procurement of goods and services, other than construction consistent with a goal of two percent (2%) or such other goals as may be determined by the Mayor, of the dollar volume to female business enterprises.

      (3)   Provide semiannual reports to the Board of Control and the Commission specifying with respect to the contracts and subcontracts:

         A.   Within thirty days after the semiannual period the means by which it intends to meet the goals established by Section 547.31;

         B.   The dollar percentage and dollar volumes of all contracts and subcontracts it has let during the semiannual period which were let to minority business enterprises and female business enterprises;

         C.   The degree to which the agency has met the goals set forth in subsections (a) and (b) hereof and an explanation of any of the departments past and current activities in trying to meet these goals.

   (b)   Private corporations, firms or persons receiving development incentives from the City, including but not limited to tax abatement, leases or sales of City property below market value and the expenditure of public funds to aid development shall award their construction and purchase contracts in order to reach the goals set forth in Section 547.31(a), above.

   (c)   Upon receipt of the semiannual report from the Commission, Council shall review the goals set forth under this section and consider appropriate amendments to this section.
