§ 70.99 PENALTY.
   (A)   Whoever shall violate any provision of this title for which a specific penalty is not provided shall be punished as set forth in § 10.99 of this code.
   (B)   Any person violating a provision of §§ 70.20 et seq. shall, upon conviction, be deemed guilty of an offense and fined not less than $25 for the first offense, not less than $100 for the second offense and not less than $200 for all subsequent offenses, but no fine shall exceed $2,500.
   (C)   Any person convicted of violating § 70.30 shall be subject to the following schedule of fines:
      (1)   First offense. Written warning with parental notification by certified mail for offenders under 18 years of age;
      (2)   Second offense. Up to $ 50 plus court costs;
      (3)   Third offense. Up to $100 plus court costs; and
      (4)   Fourth offense and subsequent offenses. Up to $150 plus court costs.
   (D)   Any person who violates any provision of §§ 70.40 through 70.42 shall be deemed to have committed an ordinance violation. Upon conviction, the violator shall be fined up to $50 per violation in addition to court costs. Each day a violation occurs or continues constitutes a separate violation. The fine shall be payable to the town and paid at the Yorktown Court Clerk's office.
   (E)   Any person violating a provision of §§ 70.55 through 70.63 shall be fined a sum not to exceed $150 for a first offense, and $250 for any subsequent offense. The penalty shall be paid to the Town Clerk-Treasurer as Clerk of the Ordinance Violations Bureau and deposited into the General Fund.
