These standards apply to all special events requiring a permit, unless expressly provided otherwise. The Special Events Coordinator or Board of Aldermen shall issue a permit if it finds that:
(A) The special event occurs between the hours of 8:00 a.m. and 10:00 p.m. except Easter sunrise services which shall be permitted before 8:00 a.m. If the Special Events Coordinator or Board of Aldermen finds that the proposed event has the potential to create a situation that a reasonably prudent person would recognize as likely to unreasonably disturb persons in the vicinity, then the Board of Aldermen or Special Events Coordinator may modify the permitted hours of operation for such special event. A decision of the Board of Aldermen in such matter is final. A decision of the Special Events Coordinator in such matter may be appealed in writing to the Board of Aldermen in accordance with § 98.15.
(B) The special event will not be held at the same time and place as another event for which a special event permit has previously been issued;
(C) The conduct of the special event will not substantially interrupt the safe and orderly movement of pedestrian or vehicular traffic at or contiguous to its location;
(D) The conduct of the special event will not require the diversion of so great a number of police officers of the town that adequate police protection cannot be provided to the remainder of the town;
(E) The concentration of persons, animals, and vehicles at assembly points for or at the location of the special event will not substantially interfere with the town's ability to provide adequate fire, police and emergency services;
(F) Special event permits shall not be issued for “for-profit” events except in connection with town sponsored events or activities associated with the North Carolina Holiday Flotilla;
(G) Merchandise sales or donation solicitations by a person or group for the purpose of raising money for a charity or non-profit group may only be conducted on public property with an approved special event permit. Information concerning non-profit vending activities must be included in the special event permit application;
(H) The special event will comply with the noise ordinance found in Chapter 97 of this code;
(I) Adequate sanitation and other required health facilities are or will be made available in or adjacent to any public assembly areas;
(J) There are sufficient parking places to accommodate the number of vehicles reasonably expected; no vehicles including transportation services may block any public streets or highways; and no buses may be used to transport participants on any of the following streets: Arrindale, Chadbourn, Oceanic, Birmingham, East and West Columbia, East and West Atlanta, Charlotte, Raleigh, Augusta, East and West Asheville, East and West Fayetteville, East and West Oxford, East and West Henderson, East and West Greensboro, Seagull, Shearwater, Heron, Sandpiper, Crane, Mallard, South Ridge, and North Ridge; and
(K) The location and duration of the display of signs may be limited by permit condition to avoid sign congestion.
