A. Definition Of Garbage: The term "garbage", when used in this section, shall mean any discarded, used or unconsumed substance or waste. "Garbage" may include, but is not limited to, any trash, refuse, debris, rubbish, grass clippings or other lawn or garden waste, newspaper, magazines, glass, metal, plastic or paper containers, any nauseous or offensive matter of any kind, any object likely to injure any person or anything else of an unsanitary nature and waste or scrap building materials that are not completely within a dumpster, leach box or metal garbage container.
B. Accumulation Of Garbage Prohibited: No person shall discard, leave, cause or allow garbage to accumulate on private property in the village in such a manner as to constitute a public nuisance or in such a manner that the garbage may be blown or otherwise carried onto the property of another person.
C. Removal Of Garbage And Debris: If the village building commissioner determines that a property owner is in violation of this section, the owner of said property shall be given written notice of that violation. If the property owner refuses or neglects to remove such garbage and debris from the property within days after receiving said notice, the village may provide for the removal of the garbage and debris. All costs and expenses incurred by the village for such removal shall be billed to the property owner. Nothing in this section shall defer immediate and concurrent prosecution for any violation of subsection B of this section.
D. Enforcement: The building commissioner and law enforcement officers of the village shall be authorized to issue P tickets or other appropriate citations or complaints for violations of this section. The village attorney shall prosecute all violations of this section and take whatever legal measures are necessary to enforce this section. (Ord. 88-1, 3-15-1988)
E. Penalties: Any person who shall violate this section shall be punishable as provided in section 1-4-1 of this code. The imposition of a fine shall not be held to prevent the removal of garbage and debris by the village. (Ord. 88-1, 3-15-1988; amd. 1995 Code)
