8-4-6: PENALTIES:
   A.   Placing Graffiti: The penalty for violation of subsection 8-4-4A of this chapter shall be a fine in the amount set forth in section 1-4-1 of this code. In addition to a fine, the court may order the offender to pay restitution to the property owner for the costs of restoring the property to its state prior to the application of graffiti. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
   B.   Gang Related Graffiti: The penalty for violation of subsection 8-4-4B of this chapter shall be a fine in the amount set forth in section 1-4-1 of this code. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
   C.   Possession Of Graffiti Implements With Intent To Use: The penalty for violation of subsection 8-4-4C of this chapter shall be a fine in the amount set forth in section 1-4-1 of this code. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues. (Ord. 2014-16, 3-4-2014)
   D.   Community Service: In addition to or in lieu of fines or penalties as described in subsections A, B and C of this section, persons convicted of a violation of subsection 8-4-4A, B or C of this chapter, may be required by the court to perform public service work including, but not limited to, cleaning up graffiti at locations within the village.
