39.02: PURCHASES:
   A.   City Commission Approval: The city commission must approve all contracts of the city for purchases of supplies, materials, equipment, and contractual services where the valuation exceeds the sum of one hundred thousand dollars ($100,000.00) or construction management trade contracts or subcontracts (as defined in 61 Oklahoma Statutes section 102) where the valuation exceeds fifty thousand dollars ($50,000.00) prior to the signing of such contracts of the transaction of such purchases.
   B.   Competitive Bidding Required; Exceptions:
      1.   Except as hereinafter provided, all purchases of or contracts for supplies, materials, equipment or contractual services shall be made through competitive bidding.
      2.   Exceptions from the requirement of competitive bidding are the purchases of supplies, materials, equipment or contractual services as follows:
         a.   When purchased in a single transaction at a price not exceeding the amount set by 60 Oklahoma Statutes section 176H for public trusts, as amended, and 61 Oklahoma Statutes section 101 et seq., pertaining to the public competitive bidding act of 1974, as amended.
         b.   When purchased through participation in a cooperative purchasing agreement with a public procurement unit or external procurement unit as authorized by 61 Oklahoma Statutes section 139, et. seq.
         c.   When purchased through the creation of a purchasing cooperative or contract with a purchasing cooperative as authorized by 61 Oklahoma Statutes section 103(G).
         d.   Which can be furnished only by a single source or which would have a uniform price wherever purchased.
         e.   Which are purchased from or through another unit of government at a price deemed below that obtainable from private dealers, including war surplus.
         f.   When purchased at a price not exceeding a price set therefor by the state central purchasing agency or any other state agency authorized to set prices for things purchased by the state.
         g.   Whose purchase is approved by the commission as necessary for the immediate preservation of the peace, health or safety of the citizens of the city.
         h.   Contractual services of a professional nature, including engineering, architecture and medical services.
         i.   Contractual services purchased from a public utility at a price or rate determined by the state corporation commission or other governmental authority, including gas, electricity, telephone services, etc.
         j.   Small purchases on open accounts, which shall not exceed fifty dollars ($50.00) per purchase without purchase order. Open accounts shall be established only by approval of the city manager/designee.
         k.   Expenditures for professional dues and subscriptions, all of which are to be approved by the city manager in advance of encumbrance of such expenditures.
         l.   All purchases shall be made from the city warehouse, if needed items are in stock.
         m.   Goods or services of any type or kind when bid for purchase through the reverse auction bidding procedure as set by 11 Oklahoma Statutes section 17-115 et seq.
