131.21: SKATEBOARDS AND BICYCLES UPON SIDEWALKS:
   A.   Definitions: For purposes of this section, the following definitions shall apply, unless the context clearly indicates or requires a different meaning:
    BICYCLE: A vehicle with two (2) wheels in tandem, propelled by human power, and including any vehicle, regardless of number of wheels, propelled by human power; however, not including any medical transportation devices such as wheelchairs or walkers, and not including baby strollers.
   SIDEWALK: A walk or path, usually paved, for pedestrian use along the side of City streets.
   SKATEBOARD: A single platform which is mounted on wheels, having no mechanism or other device with which to power, steer or control the direction of movement thereof while being used, other than by the individual using it.
   B.   Prohibited Areas: No person shall operate or cause to be operated a skateboard or bicycle upon any sidewalk within the following defined area of the City:
All those commercially zoned areas falling between Oklahoma Avenue on the south and Santa Fe Avenue on the north and between 28th Street on the west and Lakeview Drive on the east.
   C.   Permitted Areas: It is not a violation of this section to operate a skateboard or bicycle upon the following areas of the City:
      1.   Any sidewalks in residentially zoned areas of the City;
      2.   Any part of the George Goetzinger Memorial Walking Trail;
      3.   Any of the parks of the City.
   D.   Penalty: Any person who violates this section is subject to a fine not to exceed one hundred dollars ($100.00) and/or surrender of the skateboard or bicycle for a period not to exceed thirty (30) days. (Ord. 1512, 8-16-2010)
