130.03: DETENTION OF INTOXICATED OR INCAPACITATED PERSONS:
Any person who is intoxicated, drunk or under the influence of narcotic drugs or controlled dangerous substances, or who is otherwise incapacitated to such a degree that he poses a threat to himself or to others, or if a reasonable person would consider a person to be intoxicated, drunk or under the influence of narcotic drugs or controlled dangerous substances, or otherwise incapacitated when arrested for any violation of this chapter or of this code, or of the laws of the state, that person may be detained in the city jail until no longer intoxicated, drunk or under the influence of narcotic drugs or controlled dangerous substances, or until no longer incapacitated; provided, that the person shall not be detained in the city jail for a period longer than six (6) hours.
