A. Any dog or cat not wearing a rabies tag as set forth in section 90.35 of this chapter shall be deemed to be capable of carrying or transmitting rabies.
B. Any dog or cat capable of carrying or transmitting rabies and is at large, or which has bitten a person or is suspected of being rabid, shall be impounded for a period of ten (10) days, unless the owner of the animal can prove the animal has been vaccinated as required by subsection A of this section.
