6.2.6: PROHIBITED ACTS:
It shall be unlawful for any person using any parks, playgrounds, public facilities and public grounds within the City to either perform or permit to be performed any of the following acts: (Ord. 17-O-90, 10-17-2017)
   A.   Vandalism: Wilfully mark, deface, disfigure, injure, tamper with, or displace or remove any buildings, bridges, tables, benches, fireplaces, railings, paving or paving material, water lines or other public utilities or parts or appurtenances thereof, signs, notices or placards, whether temporary or permanent, monuments, stakes, posts or other boundary markers or other structures or equipment, facilities or park property or appurtenances whatsoever, either real or personal.
   B.   Pollution Of Waters: Throw, discharge or otherwise place or cause to be placed in the waters of any fountain, pond, lake, stream, bay or other body of water, in the City park or any tributary, stream, storm drain or drain flowing into such waters, any substance, matter or thing, liquid or solid, which would or may result in the pollution of said waters.
   C.   Dumping Refuse Or Trash: Bring in or dump, deposit or leave any empty bottles, broken glass, ashes, paper, boxes, cans, dirt, rubbish, waste, garbage or refuse or other trash. No refuse or trash of any kind, nature or description shall be placed in any waters in or contiguous to any park or left anywhere on the grounds thereof but shall be placed in proper receptacles where these are provided. Where receptacles are not so provided, all such rubbish or waste shall be carried away from the park by the person responsible for its presence and properly disposed of elsewhere.
   D.   Endangerment: Endanger the safety of any person by any conduct.
   E.   Assault, Battery Or Fighting: Commit any assault, battery or engage in any fighting.
   F.   Interference: Prevent any person from using any park or any of its facilities or interfere with such use in compliance with this chapter and the rules applicable thereto.
   G.   Swimming Or Bathing: Swim, bathe or wade in any waters in or adjacent to any park except in such waters and at such places as are provided therefor and in compliance with such regulations as are adopted with respect to such use.
   H.   Dressing Or Undressing: Dress or undress except in bathing houses or structures as may be provided for that purpose.
   I.   Activity Areas: Engage in flying model airplanes, golf practice, ice skating and picnics except at locations specifically designated for such activities by the Director of Public Works. (Ord. 1096, 7-2-1974)
   J.   Vehicles In Parks:
      1.   Drive or park any motor vehicles except on a street, driveway, or parking lot in any park or to park and/or leave any such vehicle in any place other than one established for public parking.
Drive, park, or otherwise operate a motorized vehicle of any type on any recreational path whether paved or unpaved in any park. This prohibition of the operation of motorized vehicles on a recreation path shall not apply to vehicles and equipment owned by the City or authorized by the City, when being used for the maintenance of park lands and facilities.       2.   It shall be unlawful to operate any unregistered or unlicensed vehicle at any time in any City park.
      3.   It shall be unlawful for any person not holding a valid driver's license to operate any vehicle at any time in any portion of a City park.
      4.   No vehicle which has an overall length of more than twenty feet (20') or an average width of more than eight feet (8') shall be parked in any parking lot in a City park.
      5.   No vehicle shall be parked so that it occupies more than one designated parking space.
      6.   No vehicle shall be parked or left unattended in any City park after the stated time of closing.
      7.   Use of all driveways, roadways, and parking areas by vehicles in excess of eight thousand (8,000) pounds' GVW in all City parks is hereby prohibited, without special permission from the City Manager.
      8.   Operation of any snowmobile in any Municipally owned park within the City at any time.
      9.   Operation of any motorized off road vehicle in any Municipally owned park within the City at any time. This prohibition of the operation of motorized off road vehicles shall not apply to vehicles and equipment owned by the City or authorized by the City, when used for the maintenance of park lands and facilities.
   K.   Dangerous Animals: Bring any dangerous animal into the City park, and it shall be unlawful to permit any dog to be in the City park unless on a leash not more than six feet (6') in length.
   L.   Peddling: To vend, sell, peddle or offer for sale any commodity or article within any park, unless specifically authorized to do so by the City Council.
   M.   Smoking: To smoke, burn or use any cigarette, cigar, or other form of or device containing tobacco or to use any "alternative nicotine product" (as defined in subsection 4.9.4A of this Code).
   N.   Consumption Of Food/Beverages: Handle, possess or consume food or beverages inside the pool area.
   O.   Post Signs: Post, glue, tack or otherwise post any sign, placard, advertisement or inscription whatever or to cause to be erected any sign whatever on any public lands or highways or roads adjacent to or within any City park.
   P.   Alcohol: Consume or possess any alcoholic beverage at any time without a proper permit.
   Q.   Davis Road Park: It shall be unlawful to permit any animal to be within the confines of Davis Road Park.
   R.   Illegal Drug Or Substance: To possess or use any illegal drug or substance as defined by this Code or the Illinois Criminal Code.
   S.   Drone Use: To use or fly a drone without first obtaining City staff approval from the City Manager's Office.
   T.   Posted Notice: Where posted notice has been given that such activity is not permitted, no person shall walk, stand, sit (including upon a chair of any sort) or lie upon the grass or surface in or on any park, playground, public facility or public grounds. Notwithstanding the notice requirements of this subsection T, no posted notice of prohibition shall be required for areas that are by their nature not designed for walking, standing, sitting or lying by the public such as flower, garden or other planted beds, restored natural or grassy areas, wetlands and similar grounds. In addition, the City Manager or designee may order a prohibition on access to any part of any park, playground, public facility or public grounds, without posted notice, when they conclude that the public health, safety and welfare require such prohibition (such as, for example, for landscaping, cleaning or repairs) provided however that this prohibition shall first be communicated verbally to any affected person and that such person shall be provided a reasonable opportunity to remove themselves from that area.
   U.   Park In The Square: Additional prohibitions applying to the Park in the Square are codified in section 6.2B.2 of this chapter.
