ADOPTING ORDINANCE
ORDINANCE NO. 17-O-01
   An ordinance re-adopting and amending the city code of Woodstock, Illinois pursuant to the home rule powers of the city of Woodstock, McHenry County, Illinois
   WHEREAS, on January 10, 2017, the Illinois secretary of state's office certified that as of September 9, 2016 the city of Woodstock, McHenry County, Illinois (the "city") had a population of 25,528 residents as the result of a special census and became an automatic home rule unit by population; and
   WHEREAS, the city of Woodstock, McHenry County, Illinois, is a home rule municipality as contemplated under article VII, section 6, of the constitution of the state of Illinois, and the passage of this ordinance constitutes an exercise of the city's home rule powers and functions as granted in the constitution of the state of Illinois; and
   WHEREAS, on May 20, 1986 the city had adopted the city code of Woodstock, Illinois - 1986 as the new and original comprehensive ordinance (except for those items expressly saved from repeal), and since that time that city code has been further amended; and
   WHEREAS, it is now the desire of the city of Woodstock to amend and re-adopt the city code of the city of Woodstock (the "Woodstock city code") pursuant to its home rule powers.
   BE IT ORDAINED by the CITY COUNCIL of the CITY OF WOODSTOCK, McHenry County, Illinois, as follows:
   SECTION 1: That the following provisions of the Woodstock city code, with the exception of section 7.4.1 (adopting unified development regulations) which shall remain unchanged and enforceable as it currently exists, are hereby re-adopted in their entirety pursuant to the city's home rule authority:
   Title 1:   Administration
   Title 2:   Boards And Commissions
   Title 3:   Business And License Regulations
   Title 4:   Public Health And Safety
   Title 5:   Motor Vehicles And Traffic
   Title 6:   Public Ways And Property
   Title 7:   Building Regulations
   SECTION 2: That title 1, Administration, chapter 1, of the city of Woodstock municipal code, shall be amended to add chapter 1.1.6, Home Rule Authority, which shall read as follows:
Chapter 1.1.6 HOME RULE AUTHORITY
      a.    On January 10, 2017, the Illinois secretary of state certified that the city of Woodstock became an automatic home rule unit by population as of September 9, 2016.
      b.    Effective January 17, 2017, the Woodstock city code and any amendments thereto constitute an exercise of the city's home rule powers and functions as granted under article VII, section 6, of the constitution of the state of Illinois.
   SECTION 3: If any section, paragraph, subdivision, clause, sentence or provision of this ordinance shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain and continue in full force and effect.
   SECTION 4: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict.
   SECTION 5: This ordinance shall be known as ordinance 17-O-01 and shall be in full force and effect upon its passage, approval and publication in pamphlet form (which publication is hereby authorized) as provided by law.
