§ 95.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   (1)   Any person who violate any provision of §§ 95.01 through 95.03 shall have committed a civil offense and shall be subject to the following schedule of civil fines for each offense:
         (a)   Uncontested violations:
            1.   First offense: $25;
            2.   Second offense: $50; and
            3.   All others: $100.
         (b)   Contested violations:
            1.   First offense: $75;
            2.   Second offense: $150; and
            3.   All others: $300.
      (2)   Any continuing violation of §§ 95.01 through 95.03 shall be considered a separate offense for each day that such violation continues, and a separate penalty may be imposed therefor.
   (C)   Should any person, firm or corporation violate the terms of §§ 95.30 through 95.34, such violator shall be fined no less than $100 and no more than $1,000 for each tree damaged by such violation.
