Section 10.28.080   Skateboards, rollerblades, roller skates, coasters and similar devices.
   A.   General Regulations. No person shall use or ride upon any skateboard, rollerblades or roller skates, coaster, toy vehicle or similar device on any roadway, except while crossing a street at a crosswalk, and when so crossing, such person shall be granted all of the rights and shall be subject to all of the duties applicable to pedestrians.
   B.   Prohibited Areas. No person shall use or ride upon any skateboard, rollerblades, roller skates, coaster, toy vehicle or similar device in or on any public street, public sidewalk or other public property which has been designated as a prohibited area for any one or more of such activities pursuant to this section.
   C.   Designation of Prohibited Areas. The Village Council may, by resolution, designate any public street, public sidewalk or other public property as a prohibited area for skateboarding, rollerblading, roller skating or similar activity, by adopting a resolution which shall designate such area and the times when such activity shall be prohibited, and ordering the posting of appropriate signage in accordance with subsection D of this section. As used in this section, and in any resolution adopted or sign posted pursuant to this section, the term "similar activity" or "similar activities" includes using or riding on any coaster, toy vehicle or similar device.
   D.   Posting and Content of Required Signs. Prior to the enforcement of any prohibition of skateboarding, rollerblading, roller skating or similar activity in any designated area, the area shall be posted with signs which provide substantially as follows:

   E.   Exceptions to Prohibitions. Any device designated, intended and used solely for the transportation of infants or disabled or incapacitated persons, and devices designed, intended and used for the transportation of merchandise between the place of purchase and the vehicle of a purchaser or supplier, shall be exempt from this section when such devices are being used for any of such specified purposes. The Village Council, in the exercise of its discretion, may suspend, by resolution, the enforcement of the provisions of this section to accommodate special events, when it is requested to do so by the organizers of the events.
   F.   Fines. Any person who commits a violation of this section shall be subject to a fine of twenty-five dollars ($25.00).
   G.   Impounding. The Chief of Police, in the exercise of his discretion, may impound a wheeled device used in the commission of any violation of this chapter, provided the Chief of Police determines that such impoundment is necessary to protect the public safety and prevent further violations. The impoundment shall be for a period of not more than thirty (30) days.
