(A) Permit required. No person shall cause to be used any loudspeaker, loudspeaker system, sound amplifier, or other machine or device which produces, reproduces, or amplifies sound outside of buildings or other enclosed structures without first obtaining a permit from the City Secretary, as approved by the City Manager or his or her designee.
(B) Areas and time of operation. The holder of any permit issued pursuant to this subchapter shall be permitted to operate as herein defined and the operation of any such mechanical speaker or amplifier shall be permitted only between the hours of 9:00 a.m. and 8:00 p.m. on Monday through Saturday. No mechanical speaker or amplifier shall be operated on Sunday without the approval of the City Manager or his or her designee.
(C) Application. Application for a permit required by this subchapter shall be made to the City Secretary on a form prescribed by the City Council, requiring the location where the equipment is installed and any other information the city may deem necessary.
(D) Fee. The fee to accompany the application required by division (C) shall be $100 annually and may be prorated on a quarterly basis.
(E) Issuance of permit; term. The permit required by this subchapter shall be issued by the City Secretary after approval by the City Manager, or his or her designee, for a term not longer than one year, but in any event, to expire on December 31 of the current year. Permits may be issued on not less than a quarterly basis. Variances to the subchapter may be granted when reasonable by the City Manager or his or her designee.
(F) Revocation. The City Manager, for good cause, may revoke the permit issued pursuant to division (E) above after giving the permit holder ten days notice to correct any violations of this subchapter, other city ordinances, or state or federal laws.
