§ 111.18 MOBILE FOOD UNITS.
   (A)   It shall be unlawful for any mobile food unit to park or conduct business in a residential zoned district or platted residential subdivision for more than two hours in any given day; or to conduct business other than during the hours of daylight, specifically one-half hour after sunrise and one-half hour before sunset. It is an exception to this prohibition that the mobile food unit is parked or being stored at the unit's owner's residence while not conducting business.
   (B)   No person shall sell or solicit sales of merchandise from a mobile food unit except between the hours of 6:00 a.m. and 9:00 p.m.
   (C)   No person shall sell or solicit sales of merchandise from a mobile food unit within 1,000 feet of any public or private school between the hours of 9:00 a.m. and 5:00 p.m.
   (D)   Mobile food units shall not block any required parking spaces, fire lane, entrance or exit from a property.
   (E)   Attention-getting devices, such as illuminated signs, flashing lights, electronic message boards, air powered moving sock assemblies, are prohibited for use in conjunction with a mobile food unit. Non-electrical attention getting devices, such as flags, banners and pennants, must comply with Ch. 150.
   (F)   Mobile food units shall be no less than 15 feet away from any building or structure when in operation.
   (G)   Wastewater tanks shall be a minimum of 15% larger than the potable water tank and shall have a 1-inch to 2-inch valve for easy discharge of wastewater.
      (1)   Wastewater shall be disposed of at a TCEQ approved dump site or by a TCEQ licensed vacuum truck at a minimum of once per week.
      (2)   Documentation is required from dump site and/or receipts for each disposal shall be required for license renewal.
   (H)   A mobile food unit operator must possess written permission to occupy a space on public or private property.
   (I)   Satisfactory proof that adequate sanitary facilities are available during operation hours within 200 feet for use by such vendor's employees and customers including written permission from the owner/lessee of the restrooms being used by the employees and customers.
   (J)   Each mobile food unit shall provide a trash receptacle at the location of operations. Mobile food units and all parts of the property used in connection with operations shall be kept free of litter.
   (K)   The visual and structural integrity of the mobile food unit must be maintained continuously.
   (L)   Mobile food units shall maintain the following fire prevention devices:
      (1)   All mobile food units selling food cooked in the mobile food unit shall keep at least one class ABC fire extinguisher with a minimum 3A40BC rating, with visible current inspection (tagged), fully charged, and located within 30 feet of cooking equipment;
      (2)   All mobile food units producing grease-laden vapors (grills, fryers, etc.) shall keep, in addition to the extinguisher required above, a class K rated portable fire extinguisher, with visible current inspection (tagged), fully charged, and located within 30 feet of cooking equipment and near an exit.
      (3)   All mobile food units producing grease-laden particles within the mobile unit shall install an extinguishing vent hood (type 1 or other, if approved by the Montgomery County Fire Marshal or designee), which must be tested in the presence of the Fire Marshal or designee before a permit may be issued.
      (4)   All mobile food units using compressed gas (LP/propane cylinders, etc.) shall keep gas containers secured outside of the passenger area of the vending unit. Compressed gas cylinders shall be secured by one or more restraints to a fixed object or nested and secured by one or more restraints and cannot be located closer than ten feet from any trash or combustible material. All valves, hoses, and connections used shall be listed and rated for the use.
