161.11 LEGAL HOLIDAYS.
(a) The legal holidays observed by employees of the City working the average fifty-six hour work schedule (fifty-three hour work week) under the three-platoon system of the Fire Department, or an average of forty hour week under the three-platoon system of the Police Department, or employees covered under bargaining contracts of the Communications Workers of America, and both full-time and part-time employees covered under The Fraternal Order of Police, Ohio Labor Council, Inc. shall be provided for by the current prevailing collectively bargained contract of the individual bargaining unit.
(b) The legal holidays observed by all other full-time employees of the City, as defined by Section 161.01, shall be as follows:
(1) New Year’s Day
(2) Martin Luther King Day (Third Monday in January)
(3) Memorial Day (Last Monday in May)
(4) Juneteenth
(5) Independence Day (July 4th)
(6) Labor Day (First Monday in September)
(7) Veterans Day
(8) Thanksgiving Day (Fourth Thursday in November)
(9) Day following Thanksgiving Day

(c) (1) Full-time employees of the City, as defined by Section 161.01
(a)(22), in lieu of President’s Day, Columbus Day, and employee’s birthday, shall be entitled to forty hours of personal leave. The personal leave hours shall be taken at the employee’s discretion, when scheduling permits. The personal leave hours shall be used within the calendar year of their origination. Those personal leave hours not used within the calendar year of their origination shall not be accumulated to the following year, nor will the employee(s) be compensated for unused personal leave hours. Newly hired employees who begin work during the month of January shall be entitled to a full forty hours of personal leave; and beginning on July 1, 2019, all other employees in the calendar year of hire between February to December shall be entitled to eight personal leave hours in the calendar quarter in which they were hired and eight hours for each full quarter of service thereafter. (2) The Chief and Assistant Chief in the Division of Fire and the Chief and Police Deputy Chief in the Division of Police may exercise an option to receive payment for up to sixteen hours of unused personal leave at the rate of pay in effect on December 31 of the calendar year in which the leave is accrued but unused. If said option is exercised, cash payment shall be made not later than the second payday in January of the following year.

(d) When a holiday observed by City employees falls on the regularly scheduled day off for any given employee, those employees whose regular day off falls on the same day as the observed holiday will be given the next regularly scheduled day off in lieu of holiday pay, if possible. Except that employees of the Division of Fire who work the average fifty-six hour work schedule will be given an available duty day off, as determined by the Fire Chief, within ten duty days after such holiday, if possible.
(e) For each holiday observed on an employee's work day, said employee will be excused from work on such day if feasible. If one of the holidays mentioned in subsection (b) hereof occurs while an employee is on vacation leave, such day shall not be charged against vacation leave. Part-time, temporary and seasonal employees shall not be compensated for the time not worked on holidays.
(f) For the purpose of administering the provisions of this section and Section 161.12, holiday time shall apply to the tour of duty beginning on the day which is celebrated as a holiday, except that employees working an average fifty-six hour work week in the Athree-platoon system" shall be compensated for holiday time on the day the holiday occurs.
