161.12 OVERTIME AND HOLIDAY PAY ELIGIBILITY.
(a) It shall be the policy of the City to avoid overtime work except when absolutely necessary. Prior verbal authorization, subject to written authorization, shall be obtained stating the specific emergency condition to be dealt with and required activity. Mandated court appearances are exempted, and also those situations where the trial judge extends the hours of the court to conclude a case within a specific time frame. Only the appointing authority or his express designee may authorize overtime work when such overtime work is necessary to prevent loss of life, damage to property and for continuance of essential public services. Only full-time permanent nonexempt employees shall be eligible for holiday pay.

(b) Positions of the following officers and employees, who by reason of holding a position deemed to be exempt status shall not be entitled to premium payment in cash for overtime or holidays worked or be eligible to receive time off on an equal ratio return, that is, one-to-one (compensatory time):
(1) Assistant City Attorney; Assistant Fire Chief; Chief Building Inspector; Chief of Fire; Chief of Police; Police Deputy Chief; Clerk of Council; Development Director; Director of Human Resources; Human Resources Generalist; Director of Public Service; elected officials; Parks and Recreation Director; Administrative Secretary to the Civil Service Commission; Deputy Auditor; Deputy Tax Commissioner; Prosecutor; Community Affairs Manager; Deputy for Information Technology; Street Superintendent; Economic Development Manager; full-time IT technician; Coordinator of Victim Services; Parks and Recreation Program and Marketing Specialist and Recreation Superintendent (position of Recreation Superintendent is retroactive to January 1, 2019.)

(c) Employees working a full-time employment week, except those referred to in subsection (b) hereof, shall be compensated at straight time. Any hours worked in excess of forty hours a week shall be compensated for at a rate of time-and-a-half.
(d) Unless otherwise provided for by a collectively bargained contract, payment in cash shall be made for any overtime or holiday work time, due at the time of separation from City service through discharge, resignation, retirement or layoff.
(e) When an employee becomes deceased while in paid status, any unpaid overtime or holiday work time and vacation leave as provided in Section 161.15 to his credit shall be paid to the surviving spouse or to the estate of the deceased unless the employee shall expressly direct otherwise by filing a written declaration with the Auditor designating the payment beneficiary.
(f) When an employee is ordered by the appointing authority to report for work and the employee so reports, and in the event no work is then available or less than two hours of work is available, the employee shall be paid or credited with a minimum of two hours at the appropriate overtime rate of pay.
(g) If an employee is absent for any reason other than vacation or a personal day on a regularly scheduled day before or after a holiday, the employee shall be charged an additional four hours sick leave, unless he or she works the holiday.
