161.07 GROUP HOSPITALIZATION, MEDICAL CARE INSURANE, AND FLEXIBLE SPENDING PLAN BENEFITS.
(a) The City may be a self-insurer of medical, hospitalization, vision care and dental insurance benefits for its employees as defined by this section. An Administrator of the self-insurance program and excess liability insurer shall be selected pursuant to Charter Section 64.
(b) The City may advertise for group medical, hospitalization, vision care and dental insurance coverage and enter into a contract with the lowest and best bidder. Specifications and scope of coverage required shall be developed by the Mayor and modified from time to time so as to provide the best cost-to-benefit ratio for the City.
(c) The provisions of this section shall apply to all City officials as defined by subsection (d)(1) hereof and all full-time employees.

(1) Hospitalization, surgical, major medical. The City shall maintain insurance for all full-time employees, provided, however, that providing such coverage is available and in the best interest of the City to offer such insurance coverage. The expense of this plan shall be shared by the employer and the employee. The employee participation will be implemented as a cafeteria plan, which will result in a pre-tax salary reduction paid by the employee. The employees will be required to make their contribution via payrolll deduction. The City may enter into good faith discussions with the City employees should the coverage no longer be available, or the cost thereof becomes prohibitively expensive. The City shall have the final decision in maintaining the coverage.

(2) Vision care plan. The City will maintain a vision care plan for all full-time employees, with the City paying all premiums for family plan coverage.

(3) Dental care plan. The City will maintain dental coverage for all full-time employees, with the City paying all premiums for family plan coverage. Beginning January 1, 2010, annual deductibles will be fifty dollars ($50.00) for single coverage and one hundred dollars ($100.00) for single plus one and/or family coverage. Deductibles do not apply to preventative and diagnostic dental services.

(4) Life insurance. The City will maintain life insurance in the amount of one hundred thousand dollars ($100,000) for all full-time employees, with the City paying all premiums. The employee shall have the option to select life insurance coverage at fifty thousand dollars ($50,000), with the City paying those premiums, by notifying the Auditor’s Office in writing that they elect only fifty thousand dollars ($50,000) in group life insurance coverage.

(5) Malpractice insurance. The City will pay the premiums and keep in force a malpractice insurance policy for all EMS personnel in the Division of Fire.
(6) Police professional liability insurance. The City will pay the premiums and keep in force the current amount of Police Professional Liability Insurance.

(d) For the purposes of providing group medical, hospitalization, vision care and dental insurance, the following definitions shall apply:
(1) “City officials” only includes rendition of services provided by the Auditor, City Attorney, Director of Parks and Recreation, Director of Human Resources, Director of Development, Treasurer, Director of Public Service and the Mayor, and shall exclude all “City officials” not rendering full-time services, such as, but not limited to, members of Council or President of Council. The position of Treasurer shall be eligible for the aforementioned benefits only until December 31. 2015 after which time this position shall be excluded as not rendering full-time services.

(2) “Full-time employees” for the purposes of group hospitalization, medical care insurance including vision and dental insurance means any person employed by the City for a regular and consistent weekly time schedule of thirty or more hours in a position created by ordinance and shall not include seasonal, temporary or spot labor, or consultants, or anyone classified as “part-time” and job description dictating a regular work schedule of less than thirty hours per week by ordinance or resolution.

(e) Modifications as to coverage provided or terms for co-payment, deductible or primary and secondary priority may be made from time to time by the Mayor.

(f) The Auditor and Treasurer are hereby authorized to pay the cost of group medical, vision care and dental insurance for City officials and full-time employees, their spouses and children. Payment shall be made from various numbered accounts as may be established from time to time to fulfill the intent of this section.

(g) The City will administer a Section 125 Flexible Spending Plan in compliance with Internal Revenue Service regulations for all full-time and permanent part-time employees as follows:
(1) Existing benefit. Employee health insurance contributions are tax sheltered via the 125 Plan.
(2) Upgraded benefits.
A. Medical Savings Plan. This plan permits emplooyees to pay for medical expenses not covered by their insurance coverage with “before tax” dollars (i.e., co-pays, orthodontia expenses, pharmaceutical costs, etc.)
B. Dependent Children and Adults Plan. This plan permits employees to pay for dependent childcare and/or adult care with “before tax” dollars. The only requirement is that the provider be a registered care provider that either deducts taxes from its employees or pays taxes as a sole provider.
(3) Cost of Flexible 125 Plan Benefits. Participation is voluntary and the City shall pay the monthly administrative fee for any full-time and part-time employee who elects to participate.
