141.09 AUXILIARY POLICE.
   (a)    Appointment of Members. There is created within the Department of Public Safety an auxiliary police force, the members of which shall be appointed by the Director of Public Safety.
   (b)    Term of Service. Auxiliary police officers shall serve so long as the Director of Public Safety may direct, or until a resignation submitted by such member shall be accepted by the Director of Public Safety. (Ord. 2-93. Passed 1-5-93.)
   (c)    Qualifications of Members. The members of the auxiliary police force shall be appointed only after a thorough character investigation. At no time shall such force exceed thirty-five members in number and no member shall be under the age of twenty-one years.

   (d)    Control of Auxiliary Police. The Police Chief shall be the commanding officer of the auxiliary police force and, subject to the approval of the Director of Public Safety, shall have control of the assignment, training, stationing and the direction of work of such force. The auxiliary police force will have all police powers but shall perform only such police duties as assigned by the Police Chief and shall act only when in the prescribed uniform or portion of uniform. The Police Chief shall prescribe the time and place such uniform or portion thereof shall be worn. Such auxiliary members shall obey the chain of command of the Police Department and shall take orders from all regularly appointed members thereof.
   (e)    Rules and Regulations. The Police Chief shall, with the approval of the Director of Public Safety, prescribe the rules and regulations for the conduct and control of the auxiliary police force.
   (f)   Type of Uniform. The Director of Public Safety is authorized to prescribe the type of uniform or part thereof which shall be worn by members of the auxiliary police force.
   (g)    Service on Voluntary Basis. All services performed by the auxiliary police officers shall be on a voluntary basis within the corporate limits of the City, and auxiliary police officers shall be paid the sum of one dollar ($1.00) per annum for their services.
   (h)    Equipment. The Safety Director is hereby authorized to purchase all new equipment and to replace worn equipment authorized for the use of the auxiliary police force.
   (i)    Nonliability. This section is declared by Council as an exercise by the City of its police powers for the protection of public peace, health, property, safety and general welfare, and neither the City nor agent nor representative of the City, nor any individual, firm, partnership, corporation nor the receiver nor trustee nor any other agent thereof who, in good faith, executes any executive order, rule or regulation promulgated pursuant to the provisions of this section shall be liable for injury or damage sustained to person or property as a direct or proximate result of such action.
   (j)   Insurance. The Mayor is authorized, consistent with Sections 63 and 64 of the Charter, to purchase annually a contract of insurance for coverage of death, disability or medical expenses of auxiliary officers killed or injured while on duty as a member of the safety forces of this City.
   (k)    Executive Orders. The Director of Public Safety is authorized and directed to promulgate such executive orders, rules and regulations as, in his discretion, are either necessary or desirable in the administration of the auxiliary police force.
   (l)    Conflict. The provisions of this section, individually or severally, shall not be construed as intended by Council to be in conflict with any Federal or State statute or with any military or naval order, rule or regulation.
