§ 71.227 APPLICABILITY OF RULES TO OPERATION.
   (A)   Every person operating an all-terrain vehicle upon a public road or highway of the municipality shall be subject to all of the duties applicable to the driver of a vehicle by the provisions of the traffic code codified within this title, and W. Va. Code Ch. 17C, except where inconsistent with the provisions of this subchapter and except as to those provisions of W. Va. Code Ch. 17C which, by their nature, can have no application.
   (B)   Notwithstanding the provisions of division (A) above, a motor vehicle operator’s license is not required of an operator of an all-terrain vehicle when he or she is operating said vehicle in conformity with the provisions of §§ 71.221(A)(2) and (B)(2) of this title, except when the operator is under the age of 18 and is transporting a passenger under the age of 18.
