§ 972.05 MANDATORY RECYCLING.
   (A)   Residential recycling. Beginning July 1, 1993, all persons who occupy residential premises, including owners, lessees, tenants or licensees, shall separate the following types of recyclable materials produced by such residents for collection and recycling: aluminum cans, glass bottles and jars, corrugated cardboard, newspapers, pourable containers, tin/bi-metal/steel cans. Beginning July 1, 1993, the following yard waste must be separated from recyclable material produced by such residents for collection and recycling: leaves, grass, brush/tree trimmings and Christmas trees.
   (B)   Non-residential unit recycling. Beginning July 1, 1993, all persons who occupy non-residential units as defined by this article, both private and public, including owners, lessees, tenants or licensees, shall separate the following types of recyclable material produced by such premises for collection and recycling: high grade office paper, computer paper, glass bottles and jars, aluminum beverage cans, automobile and truck tires, leaves, grass, brush/tree trimmings, and Christmas trees.
   (C)   Yard waste composting program. The city will establish a yard waste composting program for the purpose of accepting yard waste from residential and non-residential units and converting that yard waste into composted material.
   (D)   Collection by unauthorized persons prohibited. Recyclable materials shall become the property of the city or the collector (see § 972.03) when properly placed at curbside for collection. No person shall pick up or cause to be picked up any recyclable materials unless specifically engaged or authorized by the City Manager to do so. Any person may sell or donate recyclable materials to any other person whether or not the recipient operated for profit. Such sold or donated material shall not, however, be picked up at curbside. It shall be a violation of this article for any person other than the city or its authorized collector to remove, tamper with or otherwise disturb recyclable materials or their receptacles which have been placed for collection by the city. In addition to the fines set forth in § 972.99, any person violating this article shall be fined an amount equal to the value of any recyclable materials which have been removed.
