The City Manager or his duly authorized representative shall provide by rule or regulation for the disposal of all recycling waste for disposal at any duly licensed and state approved landfill or disposal site for all recyclable material collected by city forces or an independent contractor. Provided, however, that any independent contractor may by agreement with the city have ownership of the recycling waste vested in the contractor and subject to disposal in the contractor's discretion, insofar as such disposal abides by all conditions, rules and regulations of the United States of America, of the State of West Virginia and local authorities at the disposal site.
