A text or map amendment and application must be reviewed in accordance with the following:
(a) Public Hearing. A public hearing must be held in accordance with the Michigan Zoning Enabling Act (PA 110 of 2006), as amended.
(b) Planning Commission Consideration. The Planning Commission must review the proposed amendment, together with any reports and recommendations from staff, consultants, other reviewing agencies, and any public comments. The Planning Commission must identify and evaluate all factors relevant to the petition, including the appropriate criteria listed in Section 1227.04, and make its findings and recommendation to City Council.
(c) City Council Action. Upon receipt of the recommendation from the Planning Commission, the City Council may approve or deny the proposed amendment. If necessary, City Council may refer the amendment back to the Planning Commission for further consideration. In the case of an amendment to the Zoning Map, City Council must approve or deny the amendment, based upon its consideration of the criteria contained in Section 1227.04
. If a conditional rezoning (Section 1227.05
), City Council may only consider the conditions offered by the applicant and may not attach any other conditions, other than those offered by the applicant.
(d) Notice of Adoption. Following adoption of an amendment by the City Council, a notice of adoption must be filed with the City Clerk and published in a newspaper of general circulation within fifteen-days after adoption, in accordance with the Michigan Zoning Enabling Act (PA 110 of 2006), as amended. The notice must include the following information:
(1) In the case of a newly adopted Zoning Code, the following statement: “A zoning code regulating the development and use of land has been adopted by the City of Wayne.”
(2) In the case of an amendment to the existing Zoning Code, either a summary of the regulatory effect of the amendment, including the geographic area affected, or the text of the amendment.
(e) Records. A record of all amendments and the Zoning Map must be maintained by the City.
