If the city proceeds in any court of record to enforce and/or defend any provision of §§ 38-2-1 through 38-2-31 herein, as from time to time amended, and is successful in either the enforcement or defense proceedings as referred to herein, the city shall recover its reasonable attorneys' fees and costs incurred in the course of those proceedings from the person and/or entity who has been found to have violated any provision of §§ 38-2-1 through 38-2-31 herein and/or who has initiated the proceedings.
